# Burundi: ordinary VAT registration and monthly return for 2026 v1.2

> **General reference only.** This Guide is general tax/accounting reference material for AI-assisted workflows. It has not been reviewed for any specific person's facts, documents, elections, deadlines, residency, filing status, or local procedures. Do not rely on it to file, pay, amend, or take a tax position without review by a qualified professional in Burundi.

## Who this applies to

Use for ordinary economic activity in Burundi, taxable imports and services supplied here, including services delivered remotely to a Burundi resident. Registration, place of supply, tax point and exemption classification are separate questions. A buyer's unregistered status does not remove its imported-services withholding obligation. [VAT arts. 2–10 and 54](https://www.obr.bi/images/LOI_N1_10_DU_16_NOVEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_12_DU_29_JUILLET_2013_PORTANT_REVISION_DE_LA_LOI_N1_02_DU_17_FEVRIER_2009_PORTANT_INSTITUTION_DE_LA_TAXE_SUR_LA_VALEUR_AJOUTEE_TVA_.pdf).

Choose the rule by transaction/registration period: the modified budget applies from 1 January and the new budget from 1 July 2026. An annual income-tax calendar does not keep the older VAT threshold in force after July. ## The base

1. Classify each supply before applying a rate. VAT art. 10 exempts specified healthcare, medicines and education subject to its conditions and implementing rules. There is no blanket intermediate rate for all medicine, educational items or essential food. The actual 2021 order annexes identify the qualifying intermediate-rate food/products. Later budget exemptions override where applicable: for example July arts. 210 and 220–223 cover specified seeds, electric/hybrid items and eligible energy/cooking products under their own conditions. Do not price those sectors using only the headline table. [VAT arts. 10 and 19](https://www.obr.bi/images/LOI_N1_10_DU_16_NOVEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_12_DU_29_JUILLET_2013_PORTANT_REVISION_DE_LA_LOI_N1_02_DU_17_FEVRIER_2009_PORTANT_INSTITUTION_DE_LA_TAXE_SUR_LA_VALEUR_AJOUTEE_TVA_.pdf); [order arts. 9–22 and annexes](https://amategeko.gov.bi/wp-content/uploads/2021/07/BOB_No5-2021.pdf); [budget arts. 210, 220–223](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf).
2. Determine the tax point: ordinary goods on delivery, services generally on receipt including installments; supplies to the State use receipt of price. Approved invoice-basis exceptions and related-party arrangements require their statutory conditions. Compute consideration excluding VAT with relevant incidental charges; import VAT includes the customs base and border charges as set by the law. [VAT arts. 11–18](https://www.obr.bi/images/LOI_N1_10_DU_16_NOVEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_12_DU_29_JUILLET_2013_PORTANT_REVISION_DE_LA_LOI_N1_02_DU_17_FEVRIER_2009_PORTANT_INSTITUTION_DE_LA_TAXE_SUR_LA_VALEUR_AJOUTEE_TVA_.pdf); [Art. 96](https://www.obr.bi/images/PDF/Loi%20de%20Finances%202025-2026%20Modifi%C3%A9e.pdf); [Art. 98](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf).
3. Deduct only VAT attributable to eligible taxable activity. Keep compliant invoices, customs documents and proof of imported-services VAT. Exclude private/exempt use and art. 21 blocked expenses. Both 2026 budget periods condition deduction/refund on checking payment of collected VAT, cooperation with that check, and an electronic invoice transmitted to EBMS when issued. July adds the traceable-payment condition above. [VAT arts. 20–23](https://www.obr.bi/images/LOI_N1_10_DU_16_NOVEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_12_DU_29_JUILLET_2013_PORTANT_REVISION_DE_LA_LOI_N1_02_DU_17_FEVRIER_2009_PORTANT_INSTITUTION_DE_LA_TAXE_SUR_LA_VALEUR_AJOUTEE_TVA_.pdf); [Art. 97](https://www.obr.bi/images/PDF/Loi%20de%20Finances%202025-2026%20Modifi%C3%A9e.pdf); [Art. 99](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf).
4. Track credits by month and age. Both budgets replace art. 24: after three consecutive credit periods, apply for refund during the following month, subject to the ministerial minimum; a credit not requested then is no longer accepted as a later carryforward, while the art. 33 refund right remains. The 2021 order art. 26 sets an ordinary BIF 15,000,000 minimum, with special categories in art. 27. Its older timing conflicts with the later budgets: use the budget timing and do not present indefinite automatic carryforward. A below-minimum credit follows the express carry exception; special categories need separate examination. [Art. 98](https://www.obr.bi/images/PDF/Loi%20de%20Finances%202025-2026%20Modifi%C3%A9e.pdf); [Art. 101](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf); [arts. 26–28](https://amategeko.gov.bi/wp-content/uploads/2021/07/BOB_No5-2021.pdf).

## Deadlines and filing

1. Monitor taxable turnover and the independent purchase/import/stock triggers. Under arts. 38–39 apply for registration by the fifteenth day of the following month; statutory invoicing begins from the first day of the month following attainment of the threshold. Retain the VAT certificate and registration date. July's lower threshold changes who is within the test; how OBR treats already accumulated first-half turnover at the July cutover must be resolved for an affected case rather than invented. [VAT arts. 37–42](https://www.obr.bi/images/LOI_N1_10_DU_16_NOVEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_12_DU_29_JUILLET_2013_PORTANT_REVISION_DE_LA_LOI_N1_02_DU_17_FEVRIER_2009_PORTANT_INSTITUTION_DE_LA_TAXE_SUR_LA_VALEUR_AJOUTEE_TVA_.pdf); [Art. 271](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf).
2. Reconcile EBMS sales, invoices, customs records, imported services, credit history and eligible input VAT. Use [monthly joint return section I](https://www.obr.bi/images/DECLARATION_TVA-_IRE-_PF_ET_AUTRES_RETENUES_A_LA_SOURCE-2021-VF-juillet-2022-vf-1.pdf): sales by rate on lines 1–4; self-supplies 6–7; foreign-services/other VAT 8; output total 9; eligible inputs 10–15 and total 16; net/credit 17–18; prior credit 19; refund request 20; carry 21; tax payable 22. Do not carry an expired budget-restricted credit merely because line 21 exists. Reconcile supplier NIF, invoice date, EBMS transmission and payment trace.
3. Declare and pay within the first fifteen days of the following month, including a nil or credit period where a return is required. OBR publishes separate [Umutangakori links by taxpayer category](https://www.obr.bi/index.php/teledeclaration-telepaiement). Keep the return acknowledgment, EBMS reconciliations and quittance/bank evidence. A refund requires its own request and evidence, not merely deducting an amount at will. Current authenticated submission and refund-screen fields remain unconfirmed. [VAT arts. 25–33 and 52–54](https://www.obr.bi/images/LOI_N1_10_DU_16_NOVEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_12_DU_29_JUILLET_2013_PORTANT_REVISION_DE_LA_LOI_N1_02_DU_17_FEVRIER_2009_PORTANT_INSTITUTION_DE_LA_TAXE_SUR_LA_VALEUR_AJOUTEE_TVA_.pdf).
4. Keep VAT books and supporting documents for ten years. If an error is found before audit notification, apply the correction rules and check affected later credits; from July the general procedure allows one correction per declaration before an audit notice. [VAT arts. 51–53](https://www.obr.bi/images/LOI_N1_10_DU_16_NOVEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_12_DU_29_JUILLET_2013_PORTANT_REVISION_DE_LA_LOI_N1_02_DU_17_FEVRIER_2009_PORTANT_INSTITUTION_DE_LA_TAXE_SUR_LA_VALEUR_AJOUTEE_TVA_.pdf); [Art. 259](https://www.obr.bi/images/LOI_DE_FINANCES_2026-2027_PROMULGUEE_compressed.pdf).

## Penalties and interest

| Item and conditions | Rule / amount | Period | Official source |
|---|---|---|---|
| VAT late declaration with tax due | 10% within first 30 days; 15% after 30 and before 60; 25% from 60 through 90; after 90 days, 30% increased by 1% per month of delay; the clause does not establish the starting-month or part-month computation convention | 2026 | [Art. 59](https://www.obr.bi/images/LOI_N1_10_DU_16_NOVEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_12_DU_29_JUILLET_2013_PORTANT_REVISION_DE_LA_LOI_N1_02_DU_17_FEVRIER_2009_PORTANT_INSTITUTION_DE_LA_TAXE_SUR_LA_VALEUR_AJOUTEE_TVA_.pdf) |
| Late nil/credit declaration | BIF 100,000 | 2026 | [Art. 59](https://www.obr.bi/images/LOI_N1_10_DU_16_NOVEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_12_DU_29_JUILLET_2013_PORTANT_REVISION_DE_LA_LOI_N1_02_DU_17_FEVRIER_2009_PORTANT_INSTITUTION_DE_LA_TAXE_SUR_LA_VALEUR_AJOUTEE_TVA_.pdf) |
| VAT late payment | 10% within 30 days; 25% after 30 days | 2026 | [Art. 60](https://www.obr.bi/images/LOI_N1_10_DU_16_NOVEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_12_DU_29_JUILLET_2013_PORTANT_REVISION_DE_LA_LOI_N1_02_DU_17_FEVRIER_2009_PORTANT_INSTITUTION_DE_LA_TAXE_SUR_LA_VALEUR_AJOUTEE_TVA_.pdf) |
| VAT understated: understatement / due tax comparison | 25% if <= half; 50% if > half; 100% for fraud | 2026 | [Art. 61](https://www.obr.bi/images/LOI_N1_10_DU_16_NOVEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_12_DU_29_JUILLET_2013_PORTANT_REVISION_DE_LA_LOI_N1_02_DU_17_FEVRIER_2009_PORTANT_INSTITUTION_DE_LA_TAXE_SUR_LA_VALEUR_AJOUTEE_TVA_.pdf) |

Do not calculate the post-90-day addition until the applicable starting-month and part-month convention is established. The procedure-law rule for started months of late-payment interest does not, by itself, settle this distinct VAT filing penalty. VAT invoice/electronic-system offences have separate provisions. Do not stack general tax and VAT-specific penalties without identifying the actual legal trigger. Current interest and every EBMS-specific penalty are not completed here.

## Cross-border points

Where a nonresident without a fiscal representative supplies taxable services, the Burundi customer, taxable or not, withholds VAT regardless of the amount under art. 54. Put the output amount on section I line 8; claim an input credit only if the separate recovery conditions are met. A nonresident carrying taxable supplies outside that mechanism must examine the approved fiscal-representative rules in arts. 45–46. International-service zero rating requires its own conditions; a foreign invoice address alone is insufficient. [VAT arts. 19, 45–46 and 54](https://www.obr.bi/images/LOI_N1_10_DU_16_NOVEMBRE_2020_PORTANT_MODIFICATION_DE_LA_LOI_N1_12_DU_29_JUILLET_2013_PORTANT_REVISION_DE_LA_LOI_N1_02_DU_17_FEVRIER_2009_PORTANT_INSTITUTION_DE_LA_TAXE_SUR_LA_VALEUR_AJOUTEE_TVA_.pdf).

## Two worked examples that recompute

Assume an already registered trader with BIF 10,000,000 taxable sales excluding VAT and BIF 4,000,000 eligible local purchases excluding VAT, all at the ordinary rate, no prior credit and all EBMS, verification and bank-trace requirements satisfied. Output BIF 1,800,000 less input BIF 720,000 gives BIF 1,080,000 due.

```oa-check
name: Ordinary monthly VAT
inputs:
  sales: 10000000
  eligible_purchases: 4000000
steps:
  - output: sales*0.18
  - input: eligible_purchases*0.18
  - due: output-input
expected:
  output: 1800000
  input: 720000
  due: 1080000
```

Assume an unregistered trader reaches BIF 30,000,000 taxable accounting-year turnover in July 2026, with no independent purchase or stock trigger before then. Under the first-half turnover rule there would be BIF 70,000,000 headroom to BIF 100,000,000, but under July law turnover is BIF 5,000,000 above the new compulsory threshold. Registration is compulsory; this is not a voluntary-registration choice. Assume August standard-rated sales BIF 5,000,000 excluding VAT, giving BIF 900,000 output tax before input credits.

```oa-check
name: July registration decision
inputs:
  turnover: 30000000
  old_threshold: 100000000
  new_threshold: 25000000
  august_sales: 5000000
steps:
  - old_headroom: old_threshold-turnover
  - new_excess: turnover-new_threshold
  - august_output: august_sales*0.18
expected:
  old_headroom: 70000000
  new_excess: 5000000
  august_output: 900000
```

## Ask the client first

- What are the period, existing registration date and taxable accounting-year turnover?
- What local purchases/imports and stock value trigger registration independently?
- Which supplies are ordinary, intermediate, zero-rated, exempt or outside Burundi?
- Are invoices EBMS-transmitted, supplier VAT verified and payments traceable where required?
- What foreign services, prior credits, refund requests and mixed-use inputs exist?
