# Faroe Islands cross-border payments and migration v0.3

> **Checked against the law.** Professional review is pending. This Guide prepares working papers for income year 2026 from the cited provisions read on 25 October 2026, with ordinary foreign-tax credit, branch attribution, corporate-loan interest and bounded later-disposal methods checked on 28 October.

## Who this applies to

Apply to Faroese payers of foreign royalties/dividends, nonresident persons and companies with Faroese-source income, and individuals changing tax residence while holding securities. Residence, source, classification and relief are separate decisions. This does not provide a treaty-rate matrix, complete PE opinion, company-migration calculation or an automatic exemption. [Tax Act §§1–2, 25][tax]; [Capital Income Act §§2–2f, 15][capital]

An individual with a Faroese home has full domestic tax liability. A person without a home also meets the full-liability stay test where presence reaches at least 180 days in a 12-month period, whether interrupted or not. This is **180 days**, not a generic 183-day treaty test. Companies can be fully liable by Faroese registration or effective management under §1(1)(8), (2). Treaty residence and the right to tax particular income must then be tested against the actual instrument. [Tax Act §1][tax]

## The base

### Domestic source and PE screening

Tax Act §2 limits nonresident liability to its listed income, with only expenses incurred to earn that income deductible under subsection 2. The categories include royalties from the Faroes, business participation through a Faroese permanent establishment, Faroese property income, dividends/issuer repurchases and the specified securities disposals. Do not treat that expense rule as allowing net taxation where a specific gross levy such as royalty tax applies. Identify the precise category and then its computation law. [Tax Act §2(1)(c)–(g), (m), (2)][tax]; [Assessment Act §7][rate]

Section 2(3)'s more-than-30-day construction, new-build, installation or assembly rule also covers the specified associated activities. Thirty days exactly does not satisfy that particular duration test, but it does not establish an exemption from §2's other routes. Keep contracts, project dates, sites, personnel and connected activities. A treaty can limit the domestic result only after its actual scope and PE provisions have been established. The ordinary fixed-place/attribution method follows below; agency tests, aggregation and exclusions need the actual applicable instrument. [Tax Act §2(1)(d), (3)][tax]

TAKS explains that domestic fixed-place interpretation follows the treaty concept, referring to Nordic Article 5 and listing management premises, a branch, office, factory, workshop and extraction site. Establish an actual place and business activity; this list alone does not decide an agency or treaty exception. Once a branch PE is established, attribute the income it would earn as an independent enterprise dealing at arm's length with its head enterprise. Include connected asset gains/losses and deduct only expenses incurred to earn the Faroese taxable income. Build an evidenced bridge from attributable third-party receipts, direct costs and supportable head-office allocations, then the Faroese tax adjustments. This is a profit-attribution working paper, not a gross-receipts levy. [Tax Act §2(1)(d), (2)][tax]; [TAKS VLS C.2, fixed establishment][residence]

For example, an established ordinary company branch with DKK 1,000,000 attributable receipts, DKK 600,000 deductible direct costs and DKK 100,000 independently supported attributable head-office costs has DKK 300,000 ordinary profit before other tax adjustments, and DKK 54,000 at the qualifying 18% company rate. These allocations are hypothetical proved inputs, not automatic percentage deductions or a method for attributing internal finance/intangibles. Reconcile depreciation, financing limitations and losses under the corporate/TP Guides. [Tax Act §§2(2), 31, 37b][tax]; [Assessment Act §5(2)][rate]

### Royalties and distributions

Classify the contract first. Tax Act §2(1)(c) covers consideration for the use/right to use the stated copyright, films/broadcast material, patents, trademarks, designs, models, plans, secret formula/process and industrial/commercial/scientific experience. It does not turn an outright asset sale or an ordinary service into a royalty merely because intellectual property is involved. TAKS distinguishes a licence from transfer of ownership. Resident royalties are ordinary B-income under §§1, 25; foreign royalties start with the 25% gross charge. [Tax Act §§2(1)(c), 25][tax]; [Assessment Act §7][rate]; [TAKS royalties][royalty]

For a gross contractual royalty, withholding equals gross entitlement × 25%; net equals gross less withholding. For a contract actually guaranteeing a fixed net entitlement and requiring the payer to bear the tax, gross = net / (1 − applicable rate). A gross-up requires the contract and correct legal rate, not an assumption that the payer will bear the recipient's tax. [Assessment Act §7(1)][rate]

Capital Income Act §1(2) broadly defines distributions. Final-liquidation-year distributions follow disposal treatment under §1(3); a capital reduction can receive that treatment with TAKS permission under §1(4). An issuer repurchase ordinarily follows dividend treatment under §5 unless its permission or specific exceptions apply. Fully Faroese-taxable company/fund recipients holding share or contributed capital are exempt under §9(1); foreign recipients cannot claim that domestic full-liability exemption merely because they are companies. Apply the recipient-specific §15 starting rate before verified treaty or other relief. [Capital Income Act §§1, 5, 9, 15][capital]

### Individual exit, deferral and immigration

When an individual becomes tax-resident in Denmark, Greenland or another country, §2a treats the securities as disposed of if their market value exceeds DKK 100,000. Negative-acquisition-basis shares are caught independently. The threshold tests **market value**, not gain; exactly DKK 100,000 does not cross that limb. Compute the overall statutory net gain using the applicable securities basis/FIFO rules and §14 rate. This rule is not evidence of a general company or business-asset exit tax. [Capital Income Act §§2a, 4, 14][capital]

A realisation-basis taxpayer can seek deferral under §§2b–2c. The departure return and securities inventory are due **no later than the departure day**, with adequate security in the form of a bank guarantee matched to the deferred tax. Create both the security-by-security inventory and a deferred-tax balance. Do not label deferral unconditional or replace that deadline with the next ordinary annual return. [§§2a(2), 2b, 2c(1)][capital]

For each later disposal, use the original acquisition basis used in the exit computation, actual sale proceeds and FIFO. For a positive gain, compute the Faroese tax and credit eligible actual foreign tax under the applicable treaty or §19; pay the positive residual and reduce the deferred balance by the payment. If comparing actual proceeds with departure value produces a loss, §2c(3) separately reduces the balance by that loss's Faroese tax value. A foreign deduction of that loss invokes the separate foreign negative-tax-value payment rule; do not ignore it. Actual acquisition-basis losses have §2c(4)'s separate adjustment. Death is treated as disposal of all inventory securities under subsection 5.

**Bounded later-disposal control:** original cost DKK 100,000, departure value DKK 150,000 and initial deferred tax DKK 17,500; later sale DKK 140,000, no foreign tax, no foreign deduction of the value fall, no other inventory securities or prior balance adjustments. Actual gain DKK 40,000 gives DKK 14,000 tax paid and reduces the balance to DKK 3,500. The DKK 10,000 fall from departure value has DKK 3,500 Faroese tax value, reducing the remaining balance to zero. Do not substitute departure value for the original gain basis, or import this fixture into foreign-loss or rising-value cases without the separate §2c computation. For each year with a positive deferred balance, a return with address is due by 1 May of the following year. [§2c][capital]

On return to Faroese tax residence, apply the exit/deferral rules up to the return date for securities still held, then use market value on return as the incoming basis while retaining the actual acquisition date. For other incoming individuals, §2e likewise preserves acquisition date and uses incoming market value. Listed securities use that day's quoted value; unlisted securities start from the company's net asset value at the end of the last accounting period before arrival, unless TAKS approves a better evidenced valuation. [§§2d–2e][capital]

Apply the separate §2f loss restriction: capital-income losses are not deductible to the extent they arise from disposal proceeds below the incoming value established under §2e. The incoming market-value basis is therefore not an unrestricted promise of relief for every later loss. Preserve both the arrival valuation and actual disposal evidence. [Capital Income Act §2f][capital]

From **1 May 2026**, TAKS treats dividend refunds as assessment-amendment requests. Use its current digital form with dividend/tax evidence and residence-authority confirmation. The ordinary deadline for income year 2026 is **31 December 2029**; retain receipt evidence and check transitions separately. This practice did not newly enact §8 and does not establish the royalty-refund time limit. [TAKS notice][refund]; [Tax Administration Act §8(2)][admin]

TAKS requires advance approval before each distribution for its described Nordic/Swiss company route. Without approval, withhold and claim refund. Verify the actual treaty, residence and ownership conditions. The page's simplified 35% summary cannot override the statutory 18% starting rate for an entity within §15(1)'s second sentence. [TAKS dividend refunds][refund]; [Capital Income Act §15][capital]

TAKS's royalty page directs a foreign recipient to its royalty-refund form and the payer to annual notification. Verify the current form, residence evidence and case-specific relief before claiming. The page's broad 0% treaty summary is not a substitute for reading the actual treaty or permission to omit domestic withholding. [TAKS royalties][royalty]

## Penalties and interest

Late royalty remittance under Assessment Act §7(2) carries **1% per month from the due date until paid**. Subsection 3 disallows an income-tax deduction for that interest and applies statutory enforcement. The section does not say “per commenced month”; do not substitute the ordinary 0.7% rule. [Assessment Act §7(2)–(3)][rate]

Late dividend withholding carries **0.7% per commenced month** from the due date, including booked interest as specified, and is not deductible. Late separate capital returns attract estimated assessment, a DKK 1,000–5,000 fine and a 2% increase if less than seven days late or 5% if at least seven days late, with supported application relief under §18(7). [Capital Income Act §§15(4), 18(1), (7)][capital]

Missing the departure return/inventory deadline forfeits deferral and gives **0.7% per commenced month** from the tax's original due date, unless TAKS waives the deadline under §2b(5). Missing the continuing §2c(6) return makes the deferred balance payable, subject to TAKS's waiver discretion. No automatic waiver is assumed. [Capital Income Act §§2b(4)–(5), 2c(6)][capital]

Tax Act §141(1)(2)–(3) provides a fine for intentional or grossly negligent failure to withhold/remit royalties or supply the specified §§118–124 information. Evasion intent or other aggravating circumstances can lead to detention or imprisonment up to two years under subsection 2. The provision states no fixed monetary fine. False tax information has separate §§139–140 exposure. [Tax Act §§139–141][tax]

## Cross-border points

For each payment or migration event, record domestic residence/source, counterparty and beneficial-owner identity, treaty residence, the treaty actually in force for that date, income article and PE connection, domestic starting tax, entitlement to relief and procedure. A country on an authority list does not by itself establish that a payment is exempt. Do not apply EU directives or Danish domestic rules without Faroese authority.

Controlled-transaction pricing and thin capitalisation belong to the separate TP Guide. [Tax Act §§37a–37b][tax]

**Ordinary corporate-loan interest:** a non-bank Faroese company paying genuine loan interest to a foreign company with no Faroese full liability, PE connection or other domestic taxable connection has no withholding imposed by the cited ordinary royalty, distribution or bank-deposit provisions. This is an inference from their defined scope, not a treaty-granted zero rate: Tax Act §2 exhaustively lists nonresident income categories without a general loan-interest category; Assessment Act §7 covers royalties; Capital Income Act §15 covers distributions; §16 covers interest credited by Faroese banks/postgiro to individuals/estates. Thus DKK 20,000 genuine interest in that bounded fixture is paid DKK 20,000 without those withholdings. A disguised distribution, bank deposit, PE-connected debt, different recipient or special instrument requires its own classification; §16's 35% bank-deposit withholding must not be described as a general corporate-interest rate. [Tax Act §2][tax]; [Assessment Act §7][rate]; [Capital Income Act §§2, 15–16][capital]; [TAKS VLS C.2][residence]

### Ordinary foreign-tax credit

For foreign ordinary income from a country **without a double-tax treaty**, Tax Act §154 allows credit for foreign income tax actually paid or withheld, limited to Faroese tax attributable to the same income. Capital Income Act §19 supplies the separate capital-income rule. Include the eligible foreign income in the correct Faroese base before relief. For a positive ordinary worldwide base, the ordinary limit is `Faroese income tax before foreign relief × eligible net foreign income / worldwide taxable income in that calculation`; credit is the lower of that limit and eligible foreign tax. This is a credit from tax, not a second deduction of the foreign tax from the income base. [Tax Act §§25, 154][tax]; [Capital Income Act §19][capital]; [TAKS VLS O.1.1–O.1.4][relief]

Use only income and tax belonging to the same calculation. Deduct foreign-related expenses from the foreign numerator; allocate expenses relating to both sources proportionally to their gross income. Keep countries separate, and separate income types where methods or tax calculations differ. Special-rate income has its own computed-tax cap. Retain source-income, expense and paid/withheld-tax evidence. Treaty entitlement, losses or a nonpositive denominator, tax changes/refunds, unused-credit treatment and return-field implementation require their own checks. [TAKS VLS O.1.3–O.1.7][relief]

For individuals, TAKS distinguishes ordinary tax credits from refundable child credit: ordinary credits are allocated before foreign relief as described in O.1.8, while child credit follows relief and retains its statutory refund treatment. Relief is allocated proportionally between national, municipal and church tax under O.1.9. Do not copy the older guidance's illustrative bands or foreign-work deduction amounts into a 2026 calculation; use the current income-tax Guides and the actual treaty where relevant. [TAKS VLS O.1.8–O.1.9][relief]; [Assessment Act §§1–3][rate]

[Ordinary company credit and its supporting arithmetic](../../../ledgers/faroe-islands-2026-evidence/fo-cross-border-payments-supplementary-controls.md) is retained in supplementary research.

## Two worked examples that recompute

### 1. Royalty gross price and net guarantee

Assume an established foreign royalty without treaty relief and a DKK 40,000 **gross** entitlement. Withholding is DKK 10,000 and the recipient gets DKK 30,000. If a different reviewed contract guarantees DKK 40,000 **net**, gross is DKK 53,333.33 and withholding DKK 13,333.33 before applying the authority's actual rounding rules. The alternative does not change a gross-price contract. [Assessment Act §7(1)][rate]

```oa-check
name: Faroese royalty gross payment and contractual net guarantee
inputs:
  gross_contract: 40000
  net_guarantee: 40000
  rate: 0.25
steps:
  gross_contract_tax: gross_contract * rate
  gross_contract_net: gross_contract - gross_contract_tax
  grossed_up: net_guarantee / (1 - rate)
  grossed_up_tax: grossed_up * rate
expected:
  gross_contract_tax: 10000
  gross_contract_net: 30000
  grossed_up: 53333.33
  grossed_up_tax: 13333.33
```

### 2. Individual securities exit threshold and gain

Assume an individual becomes tax-resident abroad, with one qualifying security worth DKK 150,000 at departure and verified acquisition basis DKK 100,000. There are no other securities, losses, exempt items or credits. The market-value threshold is exceeded by DKK 50,000; the separate net gain is DKK 50,000 and tax at 35% is DKK 17,500. No deferral is assumed. A separate portfolio with exactly DKK 100,000 market value and no negative-basis shares does not exceed §2a's value threshold; this says nothing about other tax liabilities. [Capital Income Act §§2a, 4, 14][capital]

```oa-check
name: Faroese individual securities departure and strict value threshold
inputs:
  departure_value: 150000
  acquisition_basis: 100000
  threshold: 100000
  boundary_value: 100000
  rate: 0.35
steps:
  threshold_excess: departure_value - threshold
  gain: departure_value - acquisition_basis
  exit_tax: gain * rate
  boundary_excess: boundary_value - threshold
expected:
  threshold_excess: 50000
  gain: 50000
  exit_tax: 17500
  boundary_excess: 0
```

## Ask the client first

- Who are the payer, legal recipient and beneficial owner, and where is each tax-resident on the relevant date?
- What rights or services are supplied, and does the contract state a gross price or net guarantee?
- What are the payment/credit, distribution-decision and project start/end dates and connected activities?
- What treaty, residence certificate, ownership evidence and prior TAKS relief decisions apply?
- For migration, what are the departure/arrival dates, securities inventory, acquisition bases, market values and existing deferred balance?
- What tax was withheld or paid abroad, and what return, refund or deadline evidence is available?
