# Sierra Leone Payroll and Social Contributions v1.1

**General reference only.** This skill is general tax/accounting reference material for AI-assisted workflows. It has not been reviewed for any specific person's facts, documents, elections, deadlines, residency, filing status, or local procedures. Do not rely on it to file, pay, amend, or take a tax position without review by a qualified professional in the relevant jurisdiction.

## Who this applies to

Employers and workers within the NASSIT Act's definitions and coverage provisions, plus self-employed persons who opt to join on the prescribed conditions. Private/company pension arrangements do not by themselves exempt an otherwise covered employer. Other-law exemptions still require checking. The worker definition includes remunerated employment by or through a contractor in or in connection with the normal work of the establishment, subject to its remaining conditions. It also has specific territorial, permanent-resident and ship-crew limbs. Nationality alone does not decide coverage. [NASSIT Act 2001 ss. 2, 23-24](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf).

This Guide rebuilds the social-contribution workpaper from opened statutory text and the authority's current public instructions. It is not certification of the complete later-law chain. PAYE, minimum wage and current electronic submission remain unfinished; the old 2025 income Guide is historical material rather than an approved current computation. Independent source review does not establish complete current-law or filing approval.

## Rates, bands and thresholds

| Item and conditions | Opened statutory rule | Official source |
|---|---|---|
| Covered worker's contribution | 5% of that month's statutory earnings, deducted at month-end whether or not earnings were actually paid | [Act s. 25(1), definition in s. 2](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf) |
| Employer contribution | 10% of that covered worker's monthly statutory earnings; employer cannot recover its own contribution from the worker | [Act s. 25(2),(5)](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf) |
| Combined ordinary contribution | 15%, comprising the two separate obligations above; not a flat tax on every payslip item | [Act s. 25(1)-(3)](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf) |
| Opted-in self-employed member | 15% of monthly professional/vocational/business/occupational income, subject to membership conditions | [Act ss. 23, 25(4)](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf) |
| Remittance | Within 15 days after the contribution month ends | [Act s. 25(3)](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf); [Regulations 2004 reg. 8](https://nassit.org.sl/images/NASSIT_Reports/Regulations.pdf) |
| Initial employer/self-employed registration | Within 30 days from the Regulations coming into force or the other date from which the Act begins to apply; employer Form SS2A / self-employed SS3 | [Reg. 1](https://nassit.org.sl/images/NASSIT_Reports/Regulations.pdf) |
| Employer or self-employed business name/address/location change | Notify the Director-General within 10 days after change | [Reg. 2](https://nassit.org.sl/images/NASSIT_Reports/Regulations.pdf) |
| Employment or establishment cessation | Notify the Director-General within 30 days | [Reg. 7](https://nassit.org.sl/images/NASSIT_Reports/Regulations.pdf) |
| Pay-record retention | Minimum 12 years after the period to which pay relates | [Regs. 15-16](https://nassit.org.sl/images/NASSIT_Reports/Regulations.pdf) |

The current authority contribution/compliance pages corroborate the employee/employer split and following-month payment timing. They do not replace the Act's earnings definition or establish that every later amendment has been reconciled. [NASSIT contributions](https://nassit.org.sl/our-services/contributions?a=7-727-1), [compliance](https://nassit.org.sl/our-services/nassit-compliance).

## The base

1. Establish coverage from the employment/apprenticeship contract, actual employer and work location, contractor relationship and any evidenced statutory exemption. The s. 2 worker definition covers an employee in Sierra Leone other than ship crew; separate limbs cover permanent residents working on a ship whose owner has a Sierra Leone office/agent, or abroad for a Sierra Leone employer. Do not infer a general expatriate exemption. [Act ss. 2, 23](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf).
2. Build an earnings bridge from every payslip item. Section 2 covers cash emoluments earned under express/implied employment terms at fixed/determined intervals for normal work, tasks or volume, and includes leave earnings and the stated included allowances. It excludes presents, food concessions, house-rent allowance, overtime allowance, travelling allowance, bonus, commission and similar allowances. Labels must match actual substance and the provision. Do not turn this into either an automatic gross-pay base or a rule limited to one account named basic salary. The printed included-allowance wording needs the interpretation check recorded under Sources. [Act s. 2](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf).
3. Apply each contribution to the verified earnings base for the month, including accrued but unpaid earnings under s. 25(1). Preserve the employee deduction and employer cost separately. The employer share cannot be charged to the employee or used to reduce remuneration. Deductions are held in trust until paid to NASSIT. [Act ss. 25(1)-(3),(5)-(6), 29](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf).
4. Where employment is concurrent, each employer has its own obligation. A company/private pension does not switch off NASSIT. For a month throughout which a member is entitled to invalidity pension, no contribution is payable for that member. Instead credit the contribution that would have been payable on that member's average monthly earnings during the 12 months preceding the month in which entitlement began. [Act ss. 24, 26, 28](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf). Concurrent-employer contributions are credited to the same membership. [Regulations reg. 8(2)](https://nassit.org.sl/images/NASSIT_Reports/Regulations.pdf).
5. Do not recover a missed prior-period employee deduction from a later month's earnings automatically. The Act's exception requires an accidental mistake or a clerical error, with deduction according to a Trust inspector's written instructions. It never authorises recovery of the employer share. [Act s. 25(5)](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf).

The Act's tax-deductibility statement is in s. 20(2). The exact interaction with the current PAYE return and any income-tax limits still needs reconciliation; it is not authority to invent a payroll deduction box. Benefit classes include old-age/invalidity/survivor pensions and the specified grants/gratuities; a contribution workpaper does not itself establish benefit eligibility or the amount payable. [Act ss. 20(2), 38](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf).

## Deadlines and filing

1. Register the establishment using SS2A and the employee using the appropriate SS1A parts, certified as prescribed. Record issued registration/membership numbers; a worker already registered supplies membership evidence to a new employer. Record changes and cessation on their separate clocks. [Regs. 1-7](https://nassit.org.sl/images/NASSIT_Reports/Regulations.pdf).
2. For each month prepare earnings and both contribution shares. On the contribution schedule include employer name, location/postal address and registration number, manner of payment, each employee's name and membership number, earnings, employee deduction, employer amount and period total. [Regs. 11-12](https://nassit.org.sl/images/NASSIT_Reports/Regulations.pdf).
3. Pay within the statutory 15 days using the authorised office/payment method. The Regulations permit specified payment instruments or another manner authorised by the Director-General in writing. SS4A accompanies payment, unless another form/media has written authorisation. A consolidated branch payment requires separate schedules and distinctly identified unit amounts. [Regs. 8, 10-12](https://nassit.org.sl/images/NASSIT_Reports/Regulations.pdf).
4. Obtain the official dated, stamped and authorised SS4B receipt required by reg. 13. Reconcile that receipt, bank movement, schedule total and payroll liability, and retain employee pay/name/membership/deduction records for the statutory period. A bank debit alone does not establish the prescribed discharge evidence. The exact current electronic equivalent of the receipt has not been authenticated. [Regs. 13, 15-16](https://nassit.org.sl/images/NASSIT_Reports/Regulations.pdf).
5. Maintain a separate PAYE workpaper and obtain the current NRA withholding return/schedule, bands, exclusions, employee contribution treatment and payment instructions before a current income-tax filing. The old common following-month date is not verified here as the complete current PAYE calendar. Neither successful NASSIT payment nor this Guide's examples certify the PAYE position.

Reg. 9 separately makes a person assuming employer responsibility for an establishment responsible for predecessor contribution/document defaults within its terms. Include NASSIT arrears and records in an establishment-takeover check. Refund under reg. 14 requires the Director-General's satisfaction that payment was not due; benefits already paid, set-off and requested application/evidence conditions apply. [Regs. 9, 14](https://nassit.org.sl/images/NASSIT_Reports/Regulations.pdf).

## Penalties and interest

Under the opened s. 27, late contributions attract interest linked to the 90-day Treasury-bill rate plus 20% OF that rate, compounded monthly. This does not mean a fixed 20% charge or twenty percentage points added to the bill rate. Obtain the applicable rate and accepted period-conversion method before calculating money interest. [Act s. 27(1)(a)](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf).

If contribution and interest remain unpaid 30 days after service of a demand note, the text adds a penalty for each default month linked to 10% OF the 90-day Treasury-bill rate of the total outstanding. Recovery/criminal proceedings are separate. Do not replace this with 10% of arrears or ignore the served-demand trigger. Current rate inputs, calculation implementation and remission are not cleared here. [Act s. 27(1)(b)](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf).

Failure to register employees triggers the s. 30 offence and contribution arrears plus s. 27 interest/penalty. The original printed monetary fine is not reproduced as a current NLe amount without denomination/later-amendment verification. [Act s. 30](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf).

## Cross-border points

Use the statutory worker-location, permanent-residence and ship-crew tests, not citizenship or the income-tax residence result alone. A treaty's employment-income relief is not assumed to exempt social contributions. No international social-security agreement or totalisation exemption was read for this workpaper. Concurrent employment needs each employer's separate statutory responsibility. [Act ss. 2, 23, 28](https://nassit.org.sl/images/NASSIT_Reports/act2001.pdf).

## Two worked examples that recompute

Assume a covered worker has NLe 10,000 statutory earnings for the month, no s. 26 invalidity-credit situation and no unresolved base issue. Employee deduction is NLe 500, employer contribution NLe 1,000 and remittance NLe 1,500. Employer wage-plus-NASSIT cost is NLe 11,000 before other charges. This is not a complete PAYE/net-pay computation.

```oa-check
name: Separate employee and employer NASSIT obligations
inputs:
  statutory_earnings: 10000
steps:
  - employee: statutory_earnings*0.05
  - employer: statutory_earnings*0.10
  - total_remittance: employee+employer
  - employer_cost: statutory_earnings+employer
expected:
  employee: 500
  employer: 1000
  total_remittance: 1500
  employer_cost: 11000
```

Now assume actual records substantiate NLe 10,000 included earnings plus a NLe 2,000 bonus and NLe 1,000 travelling allowance that genuinely meet the s. 2 exclusions. Applying 15% to gross NLe 13,000 would produce NLe 1,950. Classifying the items correctly gives NLe 1,500, a NLe 450 difference. Relabelling ordinary earnings as an allowance does not satisfy the assumption.

```oa-check
name: Classify actual allowances before applying the contribution rate
inputs:
  included_earnings: 10000
  excluded_bonus: 2000
  excluded_travel: 1000
steps:
  - gross_pay: included_earnings+excluded_bonus+excluded_travel
  - correct_total: included_earnings*0.15
  - incorrect_gross_total: gross_pay*0.15
  - overstatement: incorrect_gross_total-correct_total
expected:
  gross_pay: 13000
  correct_total: 1500
  incorrect_gross_total: 1950
  overstatement: 450
```

Not yet confirmed: Complete later-law and commencement/amendment chain, any operative earnings ceiling or additional exemptions, interpretation of the printed s. 2 included-allowance wording “cost of leaving”, current electronic registration/payment/SS4B equivalent, rate conversion and live interest inputs, denomination/later changes to offence fines, detailed benefit eligibility and international agreements. PAYE bands, base, contribution deduction, remittance/return calendar and current fields still require the separate full income-tax reconciliation; the old 0%–30% range is not adopted as a verified current computation. The old NLe800 minimum-wage claim and generic10%–12% employer add-on estimate are not supported current figures and are held, not applied. NASSIT's verified employer contribution is the specific10% above; other employment costs need their own sources. Independent source review is separate from current-law approval; SC/PR remain partial.
