# Somalia cross-border residence working paper v0.1

> **General reference only.** This skill is general tax/accounting reference material for AI-assisted workflows. Do not rely on it to file, pay, amend, or take a tax position without review by a qualified professional in the relevant jurisdiction.

## Who this applies to

**Statutory-baseline draft for 2026 intake, not confirmed operative 2026 coverage.** Use the enacted federal Income Tax Act's residence tests to organise evidence and a provisional domestic-law conclusion. Income Tax Regulation 0142-2025 (the ministry's file name says 0141; the decree and cover page say 0142) was read and has no regulation under article 77 or 78. Regulation 106-1 lets the Minister postpone parts by public notice, and circulars can update it; those notices and circulars were not searched. Stop before final tax treatment until they have been checked. Article 105(7) expressly permits measures delaying or modifying operation. [Act 37 art.105(7), PDF page 125](https://sag.gov.so/media/documents/bulletins-contents/legislation/2025/Sharciyeedka_Canshuurta_Dakhliga.pdf).

The domestic residence definition directs the reader to article 77. Its separate tests cover individuals, partnerships, trusts and corporations. Regulation 107-1 keeps federal member states collecting the portions they already collect, under the new Act, until a legal arrangement or the circular it requires sets otherwise. This Guide does not determine territorial administration in every federal member state or Somaliland, treaty residence, immigration status or whether a non-resident has a PE. [Act 37 arts.2(7),77](https://sag.gov.so/media/documents/bulletins-contents/legislation/2025/Sharciyeedka_Canshuurta_Dakhliga.pdf).

The signed enactment page is dated 11 May 2025; the gazette wrapper is dated 17 August 2025, while article 106 also refers to publication. This draft avoids deciding the first liable day in 2025. The English manual states 11 May 2025 as commencement, but it does not settle regulatory transition for 2026. [Act 37 enactment page 2 and art.106, PDF 125](https://sag.gov.so/media/documents/bulletins-contents/legislation/2025/Sharciyeedka_Canshuurta_Dakhliga.pdf); [Ministry manual introduction](https://mof.gov.so/sites/default/files/Publications/Somalia%20Income%20Tax%20Manual_English%20Version.pdf).

## Rates, bands and thresholds

These are residence tests, not tax rates. Each is subject to the regulatory gate above.

The individual grounds are alternatives. A 182-day total does not defeat a separate home, citizenship or government-posting ground. Foreign incorporation alone does not defeat the effective-management ground. [Art.77](https://sag.gov.so/media/documents/bulletins-contents/legislation/2025/Sharciyeedka_Canshuurta_Dakhliga.pdf).

## The base

Prepare an internal residence schedule in this order. These are evidence recommendations, not an official residence-certificate form.

1. **Identify the legal person and assessment year.** Obtain identity/entity documents, prior-year residence facts and any approved accounting period. Distinguish an individual, partnership, trust and corporation; entity labels alone do not answer article 77. [Arts.3,25,77](https://sag.gov.so/media/documents/bulletins-contents/legislation/2025/Sharciyeedka_Canshuurta_Dakhliga.pdf).
2. **For an individual, test every ground.** Record citizenship; each permanent home and the periods it was available; and any federal/state government posting. Collect actual arrival/departure dates and evidence of presence. Test the 183-day limb separately even if another ground establishes provisional residence. [Art.77(1)](https://sag.gov.so/media/documents/bulletins-contents/legislation/2025/Sharciyeedka_Canshuurta_Dakhliga.pdf).
3. **Build a rolling presence schedule.** Deduplicate overlapping travel records, list verified presence dates, and test relevant 12-month windows commencing or ending in the assessment year. Do not restrict the statutory wording to days between 1 January and 31 December. The Act text read does not settle how a fraction of a day, transit or disputed travel date is counted; resolve those facts/rules before using a boundary result. [Art.77(1)(j)](https://sag.gov.so/media/documents/bulletins-contents/legislation/2025/Sharciyeedka_Canshuurta_Dakhliga.pdf).
4. **For an entity, retain the actual connecting facts.** Partnership: each partner's residence and dates. Trust: settlement/establishment, trustees and decision-control chain. Corporation: formation documents and where effective management actually operated during the year, with decision records. An overseas registered office or a board-meeting label is not a complete factual analysis. [Art.77(2)–(4)](https://sag.gov.so/media/documents/bulletins-contents/legislation/2025/Sharciyeedka_Canshuurta_Dakhliga.pdf).
5. **Separate status from its start/end and asset effects.** Article 78(1) contains a special start rule for an individual resident solely under the 183-day limb and not resident in the preceding year: residence begins with that 183-day period. Read the full provision before assigning a part-year position. Article 78(2)–(3) separately addresses entry asset costs and deemed disposal on loss of residence with domestic-asset exceptions. This job records arrival/departure, prior-year status and asset facts for that separate computation; it does not calculate an exit tax or promise a market-value step-up for every asset. [Art.78, PDF 93](https://sag.gov.so/media/documents/bulletins-contents/legislation/2025/Sharciyeedka_Canshuurta_Dakhliga.pdf).
6. **Record the result and next job.** State each ground met/not met, its supporting documents, the date window and any unresolved issue. The statutory assessable-income distinction is worldwide employment/business/investment income for residents; non-residents have the specified Somali-PE income and other Somali-source income. Source and PE attribution, exemptions and final tax are separate decisions. No domestic residence finding itself proves treaty relief or a foreign-tax credit amount. [Art.11, PDF 36–37](https://sag.gov.so/media/documents/bulletins-contents/legislation/2025/Sharciyeedka_Canshuurta_Dakhliga.pdf).

## Deadlines and filing

The deliverable is the residence/transition evidence schedule. No official residence-certificate application, current portal path, box number, approval workflow or post-2026-authority-transfer submission route was verified. Do not issue a certificate or mark a return submitted from this working paper.

Before registration or return preparation, confirm the competent administration, actual form, applicable tax year, payment obligations and acknowledgement process. Law 56/2026 provides for administration of federal revenue laws and transfer from the ministry's Revenue Directorate; reading that statute does not establish that an old web form is the current operational route. [Law 56 arts.23,26, PDF 19–21](https://sag.gov.so/media/documents/bulletins-contents/legislation/2026/Sharci_Lr_56_Hayadda_Dakhliga_Qaranka.pdf).

## Penalties and interest

No residence-specific penalty, interest rate, late-return charge or appeal period is asserted. The relevant current administration and procedure rules were not read for that job. Preserve notices and due dates for separate review; absence of a number here does not remove a compliance obligation.

## Cross-border points

Use this domestic-law schedule before considering treaty tie-breakers, PE exposure, source, withholding or foreign-tax credits. Those questions remain out of scope. A person can need source/PE work even if the provisional domestic result is non-resident. A resident moving abroad needs article 78 asset/transition work before concluding there is no exit consequence. [Arts.11,77–78](https://sag.gov.so/media/documents/bulletins-contents/legislation/2025/Sharciyeedka_Canshuurta_Dakhliga.pdf).

For a resident's dealings with an associated non-resident, use the separate [related-party pricing working paper](so-transfer-pricing.md), which has its own regulatory gate. No treaty reduction or documentation exemption is granted by either draft.

## Two worked examples that recompute

**Exactly 183 verified days.** Assume the relevant 12-month window falls within 2026, has three separate non-overlapping periods of 90, 70 and 23 verified presence days and includes presence during the assessment year. The aggregate is 183; the statutory day-count limb is met. The previous-year residence and article 78 start-date review remain separate. No tax amount follows from the arithmetic alone.

```oa-check
name: Exact statutory presence boundary
inputs:
  first_visit_days: 90
  second_visit_days: 70
  third_visit_days: 23
  threshold_days: 183
steps:
  aggregate_days: first_visit_days + second_visit_days + third_visit_days
  days_above_boundary: aggregate_days - threshold_days
expected:
  aggregate_days: 183
  days_above_boundary: 0
```

**One day below, but the home test changes the decision.** Assume three verified periods of 90, 70 and 22 days, and no other relevant window reaches 183 days. The 182-day total falls short by one day. Case A also has a permanent home in Somalia: the provisional statutory result is resident under the independent home test. Case B has no Somali permanent home, is not Somali, has no relevant government posting and no other residence ground: the day test does not establish residence. The distinction is the proven home and other facts, not a different tax rate. Both cases remain subject to the regulatory gate; neither settles treaty residence or the start date.

```oa-check
name: Presence shortfall does not override another residence ground
inputs:
  first_visit_days: 90
  second_visit_days: 70
  third_visit_days: 22
  threshold_days: 183
steps:
  aggregate_days: first_visit_days + second_visit_days + third_visit_days
  presence_shortfall: max(threshold_days - aggregate_days, 0)
expected:
  aggregate_days: 182
  presence_shortfall: 1
```

The checker verifies the day totals. It does not determine physical presence, part-day rules, home availability, residence or regulatory applicability.

## Ask the client first

- What person/entity is being assessed, for which tax year and approved accounting period?
- What are the verified presence dates, passport/travel records and disputed part-days/transits?
- What permanent homes were available, where and when, and what citizenship or government posting applies?
- What were the prior-year residence and arrival/departure facts, and what assets were held at those dates?
- For entities, who were the partners/trustees/controllers and where did effective management operate?
- Which postponement notices, circulars, foreign-country/treaty claims or existing tax notices are relevant?
