Establish beneficial ownership
Confirm the recipient is the beneficial owner of the income (full right to receive, use, and enjoy it, with no contractual or legal duty to pass it to a third party). If intermediaries exist, analyse the ownership chain and prepare an anti-abuse (BEPS) opinion where the structure is complex.

Classify the income and read the treaty cap
Match the payment to its treaty article: dividends (art. 10), interest (art. 11), or royalties (art. 12). Read the treaty maximum rate for that income type under the applicable treaty. Spain caps dividends, interest, and royalties (with a 0% floor on qualifying dividends and certain interest); Canada sets a single maximum across the three. Do not copy figures here; pull the current value from the fact keys.
Watch for: The treaty rate is a ceiling on DR withholding for that specific income type, not an automatic rate.

Compare treaty cap vs domestic CT rate and apply the lower
Look up the domestic Codigo Tributario withholding rate for the same income type: dividends (art. 308), interest paid to a foreign legal entity (art. 306), and general payments abroad (art. 305). Withhold at the LOWER of the treaty cap and the domestic rate. Where the domestic rate already sits below the treaty cap, the treaty adds nothing and the domestic rate governs.
Watch for: The taxpayer applies the more favourable of the domestic and treaty rate; a treaty never raises the domestic rate.

Invoke the treaty and file the informative return
File the informative return (IR-17) where the treaty exempts the income. The former invocation procedure (Norma General 11-22: a formal DGII request within 30 business days of payment, DGII certifying within 10 business days) was REPEALED by NG 05-2023 with no published replacement, so confirm the current invocation procedure directly with the DGII before relying on the old route. Keep the DGII request, certificate, and treaty-article analysis on file as good-faith support.
Watch for: NG 11-22 is repealed and NG 05-2023 publishes no substitute procedure; the current DGII process must be confirmed, not assumed.

Procedimiento para invocar CDI (NG 11-22, derogada) — requiere actualización urgente
Para obtener los beneficios de un CDI vigente (tasas reducidas o exención del ISR dominicano), el contribuyente debía, conforme a la Norma General 11-22 (hoy DEROGADA por NG 05-2023), presentar ante la DGII una solicitud formal dentro de los 30 días laborables siguientes al pago afectado, con: (a) RNC/cédula; (b) descripción del beneficio CDI y artículo aplicable; (c) certificado de residencia fiscal vigente del beneficiario efectivo; (d) períodos fiscales afectados; (e) descripción documentada de la transacción; recibiendo la DGII 10 días laborables para certificar; y siendo necesaria la declaración informativa en IR-17 si el CDI exime la renta; y por cuanto la NG 11-22 fue derogada por NG 05-2023 (jun-2023) sin que se haya publicado norma general sustituta, el procedimiento actual de invocación del CDI ante la DGII debe confirmarse directamente con la autoridad.
