Liberia Cross-border Income, Withholding and Permanent Establishments

Classifies Liberia-source payments and nonresident business exposure for 2026, including ordinary resident and nonresident withholding, software income, asset acquisitions and the new permanent-establishment time tests. Use for Liberia nonresident tax, overseas services, software royalties, an offshore invoice, a foreign branch, withholding, a foreign tax credit or a treaty claim. The Guide separates gross withholding from a binding multi-year election for ordinary net-basis taxation and identifies special extractive-project rates. Treaty availability and entitlement require the actual instrument; this pack does not publish an assumed treaty-rate table. It is a source-cited partial draft with specific gaps for transitional PE counting, current forms and unusual payments.

RuleCondition and resultOfficial source
W01Resident nonexempt interest, dividends, royalties, licence fees and similar property-right payments ordinarily bear 15% withholding; rent has its separate rule.s 905(b) [W01]
W02Resident rent withholding is 10% if twelve-month expected rent reaches LRD 70,000.s 905(d) [W02]
W03Resident nonemployment services bear 10% withholding if a payment reaches LRD 100,000 or expected aggregate payee payments reach LRD 1 m in payer’s year. Goods are excluded; split mixed goods/services appropriately.s 905(f) [W03]
W05Ordinary nonresident rent is 15%; remit nonresident withholding within 10 days after month end with payee name/address, payment type/amount and withholding. The 2026 software-inclusive 15% rule is stated separately.s 806(b),(d),(h) [W05]
W06From the 2026 amendment, Liberia-used software is expressly within source and the ordinary 15% nonresident withholding rule for interest/dividends/royalties/licence/property-right income includes software sales. Exempt income and special project rules still need testing.amended ss 805(a)(6),806(b) [W06]
W07Ordinary payments to nonresidents for services that would be gross income for a resident bear 20% withholding. This is a gross payment rule, not a universal 20% tax on every type of nonresident individual income.amended s806(e) [W07]
W08Qualifying mining/petroleum/renewable-resource project payments have special 5% interest,5% dividends and 6% services withholding instead of ordinary rates; test payer/project status rather than assuming every investor qualifies.ss 806(f),905(h) [W08]
W09Liberian investment-asset acquisition payments to nonresidents bear 15% withholding, including nonresident-to-nonresident transactions; default creates an asset lien payable by asset management and CG approval is needed before completion. Exceptions for s 801(b)/(c) ownership interests remain.amended s806(g) [W09]

Who this applies to

Payers, nonresidents and resident businesses with foreign income. Identify payer, beneficial recipient, source, payment character, activity dates and any treaty before choosing a rate. Liberia-source includes local activity/employment, local immovable property and related indirect disposals, resident ownership disposals, locally used assets/IP, specified interest and resident dividends/management/director fees. Vessel income has the exclusive-Liberia-use exception; software is updated by 2026 law. s 805(a)–(c) [W12]

The base

From 1 April 2026, the general PE threshold is no less than 30 days of business activity in the tax year, including through an agent. Furnishing services/consultancy through personnel has a separate aggregate 30 days in a twelve-month period commencing or ending in the tax year. Apply the establishment/activity conditions and any applicable treaty, not days alone. amended s803(a),(b)(6) [W11]

Before 1 April 2026 the cited 2020 text had a no-less-than 90 day general threshold. Do not retroactively apply the new 30 day rule to a completed earlier period; transition treatment for a period straddling commencement is unresolved. s803(a),2020text [W14] December2025Act preliminarySectionThree and Part3; cover [O13]

A nonresident can elect to file under ordinary income rules, crediting withholding and potentially seeking a refund. The election covers that period and the next four periods; compare gross withholding with verified net-basis liability, not just a single payment. s 806(i) [W10]

Foreign income tax/in-lieu tax on foreign-source income can be credited, capped at Liberian tax on that income using the taxpayer’s average rate, separately for each country. It is not an unlimited credit or an automatic exemption. s 213(a)–(b) [W13]

Deadlines and filing

For each payment, retain contract, source analysis, residence/treaty documents, gross amount and withholding calculation; issue the required statement and remit on the calendar described in W05. s 806(b),(d),(h) [W05]

The public catalogue names Monthly Withholding Return, Schedule B Withholding Resident and Schedule B Non-Residents. Current boxes and the election procedure remain unverified. Use the official LRA Forms and Schedules catalogue and LITAS link published by LRA. Select the tax kind, year and TIN; reconcile the return with the working paper and withholding credits; submit the applicable return and schedules, pay against the resulting reference and preserve submission/payment confirmation. The public catalogue was read; live portal screens, box numbers, payment references and a successful filing have not been verified. Stop before submission if the live workflow differs. amended s50(b),(g),(h) [O07]

Penalties and interest

For the general late-filing, late-payment, recordkeeping and interest rules, use Tax overview. Do not invent a fixed interest rate or treat a civil late-payment charge as a criminal conviction.

For a nonresident-to-nonresident investment-asset purchase, the tax-lien/management exposure and CG approval condition are part of the amended acquisition rule, not optional invoice paperwork. amended s806(g) [W09]

Cross-border points

A ratified international agreement in force prevails to the extent of inconsistency. Treaty privileges are denied to a treaty-state resident used or established by a nonresident to obtain them; treaty relief is not automatic. s 3(e)–(f) [O01]

The TP Guide covers related dealings and treaty-conditioned corresponding adjustments. A treaty cannot be assumed to exist, to cover this tax or to grant an automatic reduced rate.

Two worked examples that recompute

Resident versus nonresident ordinary services

For the same LRD 200,000 fee, assume an ordinary nonemployment resident contractor meeting the threshold and, alternatively, an ordinary nonresident service provider. Resident withholding 20,000 leaves 180,000; nonresident 40,000 leaves 160,000. Classification changes withholding by 20,000. Project exceptions and treaty relief are assumed absent. s 905(f) [W03] amended s806(e) [W07]

Foreign tax credit is capped country by country

Assume verified average Liberian income-tax rate 20%, foreign-source income 100,000 from Country A and foreign income tax 30,000 on that same income. Maximum credit 20,000, so 10,000 foreign tax is not credited in this computation. The 20% is a case assumption, not a new tax rate. s 213(a)–(b) [W13]
