Prepare a Moldova VAT refund or tax-offset application for 2026: identify the statutory route, reconcile paid and unpaid input VAT, compute the route cap, complete the approved HG93 annex 1 application, assemble proof and follow the SFS decision and Treasury payment stages. Covers export and other exemption-with-credit refunds, specified producers, leasing, ordinary capital investment, qualifying passenger vehicles, the e-Factura excess scheme and reverse-charge energy suppliers. Distinguishes repealed PPP provisions and outstanding special-programme procedures. Use after the Moldova VAT12 return has been reconciled; do not treat every VAT credit balance as refundable.

Use this Guide for the refund application following a reconciled Moldova VAT return. First identify the actual statutory entitlement. A credit carried forward is not itself an entitlement to cash: without a refund request, HG93 point 6 carries the excess into the next period. The statutory route, supply classification, actual payment evidence and SFS decision must all match. Fiscal Code 101(2),(8),101¹–101⁸; HG93 points 2–6.
The current Code repeals article 101⁴. HG93 still contains PPP references to that article; those references do not revive a repealed entitlement. Likewise its article 101¹ building wording predates the current Code's commissioned-and-used test. Apply the Code first. The renewable-storage route in Code 101⁸ and agricultural reimbursement programme require their own operative implementation; the gaps under Sources remain open.

Prepare a period-by-period workpaper. Reconcile the opening credit to the previous return, eligible current input, output, adjustments, prior refunds and closing credit. Separate paid and unpaid VAT, recording the date of actual payment required by the particular route. A deductible invoice can be unpaid even when its VAT is already in the return; deduction and refund payment conditions are different. HG93 points 26–30,35¹,38¹,47³–47⁴.
For the ordinary exemption-with-credit route, determine which deductible input VAT is paid at initiation of the audit, then allocate output first against unpaid deductible input and then paid input. The refundable amount is the smallest of the remaining overall excess, remaining paid credit and supply-based cap. The official annex 2¹ example expressly demonstrates this order. Do not calculate the paid-input ceiling before allocating output and then use that higher figure after output has consumed paid credit. HG93 points 35¹,38¹ and annex 2¹.
For the Code 101⁶ route, first confirm that the applicant is registered as a VAT payer. Maintain separate chronological buckets: unpaid credits from January 2023 onward, paid credits from January 2023 onward, then December 2022 carry-forward. Determine eligible paid inputs at application; include the specified budget-paid VAT for cross-Nistru, insolvency and pledged/seized-property acquisitions where the conditions apply. Use the programme's own 70% ceiling and paid-excess calculation, not the export cap. Requested refunds reduce subsequent carry-forward under Code 101⁶(2). HG93 point 47³; Code 101⁶.
Do not include national-public-budget-funded investment VAT in the investment refund. For buildings retain commissioning and actual-use evidence. An unfinished, conserved or merely purchased building does not satisfy the current commissioned-and-used condition. For a supplementary claim for a previously refunded period, apply all three HG93 point 30 tests: minimum intervening credit, no intervening VAT-payable obligation, and the applicable payment requirement. Do not refund the same input again. Code 101¹; HG93 point 30,42¹,44.
MM/YYYY; for one month repeat the same period in both fields. An application with no requested amount is not examined. These are named fields, not numbered boxes.Sources: HG93 points 7–19¹,22–32 and annex 1; Code 101(8),101¹(4),101³(2),101⁶(4).
Retain the refund decision, submitted evidence and subsequent corrections. A refusal is not automatically a tax penalty. Incorrect VAT reporting engages the assessment/late-charge rules in the VAT return Guide; do not calculate a late charge on a refused refund without an actual unpaid tax debt.
For a late authority refund, Code 176(3) provides taxpayer interest after the statutory refund period, using the previous November BNM base rate rounded up to the next whole percentage plus 5 points, divided by days in the year and rounded to 4 decimal places as a daily percentage. The statutory criminal-proceeding suspension excludes interest for its suspension period. The taxpayer submits the calculation for authority verification/approval under 176(4). Use the pack's sourced 2026 benchmark calculation and actual due/refund dates; do not assume interest is paid automatically. Code 176(1),(3)–(4); HG93 point 51.
Foreign currency receipts and an overseas address do not establish an export exemption. Obtain the place-of-supply conclusion and recipient evidence from the VAT Guide, then the route-specific HG93 point 32 proof above. Keep customs/import VAT payment evidence distinct from an overseas supplier payment. Zone/port/airport claims depend on actual resident status, the elected customs guarantee regime and the evidence in point 32(11). Cross-Nistru and treaty/project-specific implementing questions remain under Sources; a foreign transfer is not sufficient proof.
Recompute HG93 annex 2¹: domestic output VAT 2,000; export value 6,000 with standard-rate cap 1,200; current input 1,000, of which 800 paid/200 unpaid; opening credit 2,500, of which 500 paid/2,000 unpaid. All eligibility/proof assumptions are those stated in the official annex, not a claim that a particular taxpayer qualifies. Allocate output against 2,200 unpaid first. The remaining paid credit is 1,300 and total excess 1,500; refund 1,200, leaving paid 100/unpaid 200. Official annex 2¹.

Hypothetical wholly eligible Code 101⁶ month after January 2023: qualifying system-documented output VAT 10,000; eligible input VAT actually paid at application 25,000; no unpaid or December 2022 credits, other adjustments or previous refunds. The paid excess is 15,000 but the 70% output cap is 7,000. Assume SFS confirms that amount, with 1,500 actual taxpayer arrears and no future-tax allocation. Offset 1,500 and bank 5,500; carry 8,000 remains. Bank receipt still requires Treasury evidence. HG93 point 47³; Code 101⁶(2),(4); approved annex 1.

Not yet confirmed: complete operative agricultural-reimbursement programme and renewable-storage article 101⁸ implementing procedures; current authority workflow for the regulatory legacy PPP references and the point 12/13 special-scheme exclusion difference; gas-trader historical December 2025 instalment claim and specific machinery/project schemes beyond the retained general regulation; authentic portal submission/acceptance, taxpayer-specific code/IBAN/payment validation, actual notices/appeal facts, foreign-currency conversion and historic refund-law transitions. These gaps do not remove the operative ordinary application and calculation methods supplied here, but prevent a comprehensive VAT-refund or country-complete claim.
