OpenAccountants/SJ/Svalbard: individual tax residence and temporary work

Svalbard: individual tax residence and temporary work

Svalbard individual tax residence and temporary-work reference checked against the consolidated Svalbard Tax Act in 2026. Explains permanent residence, the twelve-month retrospective rule, the thirty-day continuous-stay test, departure and the limited-liability regime for qualifying newcomers. Identifies the statutory exception to that newcomer restriction and distinguishes foreign employment from property outside Svalbard. Includes practical boundary cases and evidence to retain. This Guide concerns Svalbard only; the SJ catalogue code does not establish coverage of Jan Mayen. Mainland residence interactions, treaty treatment, special benefits and independent accountant review remain outstanding.

The full skill

Scope

This Guide covers Svalbard under Svalbard Tax Act section 1-1. It does not cover Jan Mayen despite the shared SJ catalogue identifier. Determine residence and source separately before applying a tax rate. This is a source-cited draft checked on 22 October 2026.

Residence starts before the twelve-month anniversary

Section 2-1 treats a person taking permanent residence in Svalbard as resident. A stay lasting at least twelve months counts as residence from the beginning of that stay. The statutory starting point is taxation of all wealth and income, subject to the Act's restrictions and exceptions. It is not a rule that taxation begins only in month thirteen. Section 2-1.

The administration explains that genuine residential attachment must be assessed on the facts; brief holiday or business absences do not necessarily break residential continuity. Keep accommodation, employment, travel and actual-living records. Tax Administration residence guidance.

Newcomer restriction is conditional

A person who was not tax resident in Norway, including Svalbard, during the preceding ten years has liability restricted by reference to section 2-2 for the first five years of Svalbard residence. This includes the relevant local work/business income, specified benefits and local real property. It is not an unconditional five-year exemption. Sections 2-1 and 2-2.

Section 2-1 also permits the tax office to set aside this restriction for a year if it excludes a significant amount from Svalbard tax; the statute defines the significant amount as twelve times the National Insurance basic amount. Do not promise that foreign investment income is always outside tax during the newcomer period. The applicable basic amount and the office's exercise of this power require a case-specific calculation. Section 2-1, second paragraph.

Temporary work: thirty continuous days

A nonresident temporarily working or conducting business on Svalbard is liable on that local income if the stay lasts at least thirty continuous days. Exactly thirty satisfies the statutory test. Section 2-2 also contains a separate rule for specified benefits, requiring active work when entitlement arose, and a separate local-property rule. Section 2-2.

For this temporary-stay test, the administration excludes travel days to and from Svalbard and treats an interruption as ending the period. Its example of fourteen days, a weekend away and twenty further days produces two nonqualifying periods, not thirty-four continuous days. Official wage guidance.

A qualifying continuous stay establishes limited liability on the relevant work income; it does not establish general residence merely because thirty days have elapsed. Conversely, a resident's brief holiday does not automatically impose this temporary-worker test on every later work period. Apply the correct statutory category. Sections 2-1 and 2-2.

Departure and income outside Svalbard

Residence-based liability ends from the income year in which time outside Svalbard exceeds 183 days in a twelve-month period. The statute says more than 183, not at least 183. The administration counts whole or partial calendar days outside and explains that the period need not be continuous. Therefore review a rolling travel history, not just a calendar-year total. Section 2-1; residence guidance.

When residence-based liability ceases, test any remaining Svalbard work under section 2-2. Loss of resident status does not itself exempt local work or local property. Sections 2-1 and 2-2.

Section 2-1 excludes pay for work outside Svalbard and business income earned outside Svalbard where it is demonstrated that the income is taxable under other Norwegian taxation or in a foreign state. Property and installations outside Svalbard, and income from them, have a separate exclusion. A foreign payer alone does not establish where work was performed or prove these conditions. Section 2-1.

Review file and limits

Record residence history for the preceding ten years, exact arrival/departure dates, travel-day treatment, work locations, property locations and evidence of foreign/mainland tax liability. Keep the newcomer exception assessment distinct from the ordinary residence decision.

Mainland Norwegian residence and departure, treaty scope, medical-absence exceptions, special benefits, offshore work and appeals require additional review. This Guide does not determine immigration permission or social-insurance membership. Independent accountant review remains outstanding.
