Prepare a Togo annual property-tax working paper for 2026 from the read CGI and LPF, with the enacted finance-law valuation overlay. Use this Guide for built and unbuilt property, liable property-right holders, cadastral valuation, the commercial balance-sheet asset rule, permanent and temporary exemptions, instalments and evidence for relief. It separates annual ownership tax from rental income tax, rental withholding and transfer duties. Two executable cases recompute a commercial property assessment and the different temporary-exemption windows for commercial and residential construction. Current cadastral forms, live payment references, special restructuring approvals and later-law continuity remain explicit holds. Trigger phrases include Togo taxe foncière, property assessment, cadastral rental value and new-building exemption.

Prepare the annual taxe foncière assessment for a property in Togo, separately from income earned by renting or selling it. CGI article 257 creates tax on built and unbuilt property. Article 258 includes buildings, fixed shelter/storage installations subject to its movable-equipment exception, private infrastructure, fixed accommodation/commercial boats, indispensable building land, specified commercial/industrial land and specified advertising land. Article 259 defines taxable urban unbuilt land and land intended for nonagricultural construction. Do not treat every undeveloped plot as taxable urban land. CGI 257–259
Identify the holder before computing: property or superficie right holder, usufructuary, emphyteutic lessee, or construction/rehabilitation lessee. For the specific article 260 construction-at-tenant-cost arrangement, calculate the tenant's constructed-property assessment and the landowner's separate rent/prestation assessment under that article; joint liability applies. Its amortisation-based tenant value is a distinct rule, so hold that calculation until the full lease and works cost are available. CGI 260
This is a bounded statutory working paper. The original 2025 consolidation and actual 2026 finance-law overlay were read. The law applies its other fiscal measures from 1 January 2026, subject to contrary provisions; article 21 replaces CGI 271. Later amendment continuity is not proved by the 2026 label. LF 2026 arts. 2, 21

The 6% valuation factor is not the annual tax rate and is not a general factor for every dwelling or vacant plot. Record the qualifying business asset, its use, balance-sheet entry and market value before applying it. Do not apply the earlier final paragraph of CGI 271 instead of the enacted replacement. Replacement CGI 271
Pay the annual tax spontaneously to the tax receiver in two equal instalments, by 31 May and 31 October. LPF 85 also states joint liability of landowner and tenant. Do not replace the statutory instalment calendar with an unverified portal instruction. LPF 85
By 31 May, owners, principal tenants, or property managers acting in their place declare each tenant's identity, premises, principal rent and charges; rent-free occupants and their premises; self-occupied premises; vacant premises; and exact taxable unbuilt-land area. New construction, reconstruction, additions and changes of size/use are notified within four months of definitive completion. Keep submission and payment evidence separately. Current form identifier, boxes, electronic route and payment reference format were not established. LPF 86–87
For the new-building exemption, provide a building permit or the article 266 commencement declaration within four months of works opening, with building nature/use, footprint, cadastral/land identification and sketch/plan; additionally submit the completion declaration within four months after completion. The text requires written administration-issued forms. A late declaration can recover only the unexpired exemption fraction from 1 January after its submission; it never exempts the first year after completion. CGI 266–267
Property is assessed in the prefecture/commune where it lies. Arrange the cadastral mutation after a property transfer: pending mutation the former owner can remain assessed and liable, subject to recourse against the buyer. A titled parcel's assessment-name change depends on transcription of the transfer act/decision in the land register. Ownership disputes go to the civil courts and suspend the assessment-name decision until final judgment; correction decisions also affect later years until the rolls are corrected. This is an assessment-record rule, not a calculation of transfer duty. CGI 281–285
Under CGI 266, missing the required construction declarations causes assessment from 1 January after completion. In the first assessment-roll year, the addition counts the years between completion and discovery, including discovery, capped at five times that year's contribution. Preserve dates and the actual notice before computing that addition. LPF 87 separately addresses undeclared construction/change using presumed completion. Do not invent a universal late-payment percentage from these provisions; general administration and sanctions are routed to the overview, and a property-specific current penalty/interest assessment remains a hold. CGI 266–267; LPF 87
Commercial/industrial vacancy or non-use relief requires all three article 278 conditions: involuntary, at least three months, and the whole property or an independently rentable/usable part. The potential window begins the first day of the month after vacancy starts and ends the last day of the month in which it ends. Built-property destruction/demolition and extraordinary disappearance of unbuilt property have their separate next-month rules. Relief requires a claim, not unilateral nonpayment. CGI 278–280
LPF 374 normally sets 31 December of the year after the relevant listed event as the claim deadline, including the year the minimum vacancy duration is met. Record the actual triggering event; LPF 375 provides a separate reassessment-period rule. Under LPF 376, claims are individual, except collectively assessed taxpayers and members of partnerships contesting the partnership tax can claim collectively. Address the claim to the Commissaire des impôts in French, on plain paper or typed, with date, handwritten signature, NIF, postal box and telephone contact. Identify every disputed assessment, its grounds and requested result. Attach the assessment/liquidation notice, provisional and final reassessment notices where the tax arose from an audit, and relevant payment, withholding or tax-credit evidence. A missing listed supporting document can subsequently regularise the claim; this does not make every admissibility defect curable. Claims are exempt from stamp duty. A representative needs the article 377 mandate unless an exception applies; a claimant domiciled abroad elects a Togo domicile. No filing/payment stay is inferred. LPF 374–378
The property-location and enumerated-right-holder tests above control this domestic assessment. A foreign owner's salary-residence classification does not determine the cadastral base. Article 261(10)'s official foreign mission residence exemption is specific; do not apply it to every foreign-owned property. A claimant domiciled outside Togo must elect a domestic domicile for its claim. Treaty-specific effects, succession, foreign-owner conveyance restrictions and foreign tax credits remain unconfirmed. Route residence and withholding questions to cross-border tax, and rental-income computation to income tax. CGI 258–261; LPF 378
Commercial asset valuation. Assume premises and incorporated installations are qualifying company balance-sheet assets, with evidenced market value CFA 100 million, and no exemption or credit. Replacement CGI 271 gives annual rental value CFA 6 million. CGI 270 reduces it to CFA 3 million net cadastral income; CGI 275 gives CFA 225,000 annual tax, with two CFA 112,500 instalments under LPF 85. This is not 6% tax on the property and does not establish a market value for another parcel. CGI 270, 275; LPF 85, replacement CGI 271.

Temporary-exemption decision. Assume completion in 2023, fully timely article 266 declarations, regular subdivision, no use change, no permanent exemption and an independently established gross cadastral rental value CFA 2 million. For assessment 2026, three years have elapsed after completion. A qualifying commercial building's two-year exemption covered 2024–2025, so its 2026 tax is CFA 75,000. A qualifying residential building's five-year exemption covers 2024–2028, so 2026 tax is zero and three exempt assessment years remain including 2026. Use follows the evidence; the owner cannot elect the residential exemption for a commercial building. Without timely declarations this example cannot be applied. CGI 262, 265–267, 270, 275.
