OpenAccountants/VI/US Virgin Islands: individual income-tax filing

US Virgin Islands: individual income-tax filing

US Virgin Islands individual income-tax filing reference checked in 2026. Separates full-year bona fide residents from US citizens and resident aliens with Virgin Islands income who do not qualify, and explains worldwide reporting, joint-return residence, dual filing and tax allocation. Includes an adjusted-gross-income allocation example, payments reconciliation and the 2025 Form 8689 credit route. Records conflicting line references in IRS Publication 570 rather than carrying them into the computation. Flags separate self-employment obligations and source determinations. Does not publish unverified 2026 return lines, tax brackets, incentives or nonresident-alien filing instructions. Independent accountant review remains pending.

The full skill

Establish the filing route

26 USC 932 coordinates US and USVI individual income tax. The official text retrieved is current through Public Law 119-121, 9 October 2026. Determine bona fide residence under section 937 first; do not choose the filing office solely from a postal address.

Sources: section 932(a)–(c); Form 8689 instructions, Who must file and Where to file. The instructions also exclude people treated as full-year residents under the special move-year rules. Check those rules before assigning a mover to dual filing.

Full-year residents: worldwide reporting still matters

Section 932(c)(4) conditions US gross-income exclusion on full-year bona fide residence, reporting income from all sources to the USVI with the source of each item identified, and full payment of the relevant USVI tax liability. A residence claim by itself does not satisfy those conditions. Section 932(c)(4).

The IRS directs a bona fide USVI resident with non-USVI-source income to attach local Form 1040INFO to the USVI return. Worldwide reporting does not mean that every item is USVI-source for a separate incentive or allocation calculation. Publication 570, US Virgin Islands and Form 1040INFO.

Joint returns

Section 932(d) applies the coordination rules using the residence of the spouse with the greater adjusted gross income, disregarding community-property laws. The 2025 Form 8689 instructions likewise direct joint filers with only one full-year bona fide resident spouse to use the higher-AGI spouse's status. Do not choose the favourable filing route merely because one spouse qualifies. Equal-AGI and other unusual cases need further analysis. Statute; form instructions.

Dual filing and allocation

The signed USVI copy includes the attachments, forms and schedules, including Form 8689. The ordinary due date is the Form 1040/1040-SR filing due date. Publication 570, US Citizen or Resident Alien other than a Bona Fide Resident.

Section 932(b) bases the USVI allocation on USVI adjusted gross income divided by overall adjusted gross income. USVI AGI includes the relevant income and properly apportioned deductions, not simply gross island sales. The form separately adjusts total tax before applying the allocation. The 2025 form's lines 30–36 cap the ratio at 1.000 and require rounding to at least three decimal places. Section 932(b); Form 8689.

Example with established positive amounts: worldwide AGI $100,000, USVI AGI $40,000 and tax after the form's required adjustments $20,000. The ratio is 0.400 and allocated USVI tax is $8,000. If documented USVI payments are $3,000, the remaining USVI balance is $5,000. This example assumes no other payment or credit and does not determine the income's source, underlying federal tax or an incentive entitlement.

Credit the tax actually paid

Section 932(b)(3) allows credit for the tax required to be paid to the USVI that is actually paid. The 2025 Form 8689 instructions use lines 41 plus 46 for the Schedule 3 Other refundable credits amount. USVI withholding from Form W-2VI box 2 belongs in the form's USVI payment reconciliation, not also in the federal withholding lines. Overpayments to one jurisdiction are not automatically applied to the other. Form 8689, page 4.

In the example above, assuming the $5,000 balance is actually paid when filing, the supported credit is $3,000 plus $5,000 = $8,000. An unpaid $5,000 balance does not become a paid-tax credit simply because it appears on the computation.

Source discrepancy: the retrieved 2025 Publication 570 instead refers to lines 40 and 45 and Form 1040 line 33. This Guide follows the actual 2025 Form 8689 instructions for the illustrated form procedure. Resolve software mapping against the applicable final form. These 2025 line references are not represented as final 2026 return instructions.

Separate obligations

A taxpayer with no ordinary US income-tax filing requirement can still have US self-employment reporting and tax obligations; Publication 570 identifies Form 1040-SS for applicable USVI business income. Residence-change reporting under Form 8898 is separate too. The worldwide-reporting route is not an exemption from every federal tax or information return. Publication 570, USVI self-employment tax; Form 8898 instructions.

Verification limits

Checked 22 October 2026 against the statute and downloaded IRS material. This draft does not settle incentives, foreign reporting, estate/trust rules, nonresident-alien cases, zero/negative AGI, all income-source exceptions or 2026 rate schedules. Independent accountant review and complete current-year reconciliation remain outstanding.
