The full skill

This Guide holds part of es-foral-income-tax, moved here unchanged on 6 November 2026 so that each Guide stays within the size the site can deliver. Built from the law; not yet approved by an accountant.

Who this applies to

An ordinary resident employee whose foral IRPF is Bizkaia, Álava, Gipuzkoa or Navarra under es-foral-income-tax and who physically works abroad for a non-resident entity or permanent establishment during 2026. Compute the rest of the return in es-foral-income-tax.

Rates, bands and thresholds

The general and savings scales of each territory are in es-foral-income-tax; the amounts this Guide applies sit in the rules under The base.

The base

Foreign-assignment employment: local exemptions

Select the competent territory before testing this ordinary resident-employee method. All four require actual foreign work for a non-Spanish-resident enterprise/entity or an overseas permanent establishment, and the comparable-income-tax/non-tax-haven condition in the own local law. A treaty with Spain containing an information-exchange clause satisfies the stated comparable-tax limb; without one, prove the analogous tax and the applicable local jurisdiction classification for that tax period. A foreign payer or work done from Spain does not by itself qualify. For linked recipients, the own local corporate rule must establish an intragroup service producing or capable of producing an advantage or utility for the recipient: Basque corporate art44.1, Navarra LF26/2016 art33, as incorporated by the local exemption/regulation and explained in the own manuals. Retain actual contracts, assignment calendar, foreign-beneficiary project/service evidence, remuneration and tax certificates. Do not transplant State7(p)'s administrative denominator correction to a local rule without its own source bridge.

Ordinary full-year worksheet. For a single employment relationship lasting all2026, segregate specific eligible foreign-service pay S from nonspecific salary N. With D evidenced qualifying foreign-assignment days and365 calendar days, calculate eligible_foreign_pay = S + N ×D/365; exempt the lesser of that amount and the territory's annual cap in the table. Specific pay is not prorated again. Subtract only that exemption from otherwise taxable gross salary, then apply the selected territory's employee expense/bonus rules; this is not a deduction of60,100/60,000 from every salary. The annual cap is one per taxpayer/year, not per trip or country. The own B/A/G regulations each expressly use total days of the year; the current own Navarra regulation permits the shorter accrual duration. A fully evidenced45-day assignment,36,500 nonspecific salary and2,000 specific pay gives6,500 exempt in each of the four systems and32,000 residual gross before local expenses. With80,000 wholly eligible foreign salary and no separate exempt reimbursement, B/A/G exemption is60,100 and residual19,900; Navarra exemption is60,000 and residual20,000. B DF47/2014; A DF40/2014; G DF33/2014; N DF174/1999.

Navarra shorter relationships and payers. Currentreg5 expressly uses the year's days or the shorter total remuneration-accrual days. The own2025 manual expressly requires separate calculation for each payer, using the actual employment duration if less than a year, then one aggregate60,000 annual cap. For each qualifying relationship j, calculate S_j + N_j ×D_j/T_j, with T_j its actual in-year duration (365 for a full2026 relationship); sum the eligible results before the cap. Do not aggregate unrelated no-assignment payer earnings into that daily salary. A184-day relationship paying18,400 nonspecific and3,000 specific, with46 qualifying days, gives7,600 exempt and13,800 residual gross. With successive payers27,300/273days/39foreigndays and18,400/92days/36foreigndays, the nonspecific exempt amounts are3,900 and7,200, totaling11,100 before the one cap. These own Navarra sources support the method; the StateTEAC ruling is not its authority. N DF174/1999; N2025 manual physical25–26.

Basque shorter relationships and successive payers: literal own-regulation worksheet. Each province's own article11.2 expressly uses the total days of the year for nonspecific pay and separately includes specific foreign-service remuneration. Applying that wording to an otherwise eligible ordinary part-year relationship, use S_j + N_j × D_j/365 for2026. N_j is the actual nonspecific remuneration earned in relationship j, without annualising it; S_j is that relationship's specific eligible foreign-service pay; D_j is its evidenced qualifying foreign-assignment days. Calculate each employment relationship separately, add the eligible results, and apply one annual taxpayer cap of60,100. An unrelated relationship with no qualifying foreign work contributes nothing to the exemption. Do not apply the cap per employer, count specific pay twice, or insert another payer's domestic-only pay into the assignment's daily salary. This is an expressly labelled literal application of the three own regulations, not a claim of a published local part-year ruling or a binding interpretation; the examined article11 texts print no shorter-duration substitution. The separate Navarra shorter-accrual method and State administrative correction are not their legal authority. An actual applicable contrary local interpretation remains a source boundary. Sources: own Bizkaia DF47/2014 art11.1–2, Álava DF40/2014 art11.1–2, Gipuzkoa DF33/2014 art11.1–2, read31October2026.

For an eligible184-day2026 relationship, actual nonspecific salary18,400, specific foreign-service pay3,000 and46 undisputed qualifying days, this literal Basque worksheet gives 3,000 +18,400×46/365 =5,318.904109…, displayed as5,318.90, and residual gross16,081.095890…, displayed as16,081.10. The relationship's184-day duration does not replace365 in this particular construction. For successive eligible relationships with nonspecific pay27,300/39qualifying days and18,400/36qualifying days, with no specific pay, the unrounded components are2,916.986301… and1,814.794520…: sum before rounding to get4,731.780821…, displayed4,731.78. These are derived diagnostic controls of the stated own-text interpretation, not prescribed return-box rounding or results from2026 filing software. Retain unrounded components through the annual cap. A separate domestic-only salary does not increase4,731.78. The linked controls also test the single cap and separate specific pay.

Day and denominator boundaries. Bizkaia's own2026 Instruction2.2.10 includes arrival/departure days and nonworking days within an employer-ordered qualifying assignment, but excludes private stays before/after work and private holidays abroad. Keep actual service and private-travel evidence separately. For the shorter-relationship and successive-payer computation, use the labelled own-regulation worksheet immediately above; an actual contrary local administrative or judicial interpretation must be applied to its stated scope rather than silently substituted from State guidance. Likewise, the exact own Álava/Gipuzkoa/Navarra implementation for disputed travel/private-day combinations is not supplied by simply borrowing Bizkaia or State guidance. The numerical controls assume undisputed qualifying days. These are ordinary bounded source questions, not specialist exclusions. B Instruction1/2026 section2.2.10; B DF47/2014; A DF40/2014; G DF33/2014; N DF174/1999.

Excess election and correction gates. This exemption is incompatible with the own expatriate-excess regime irrespective of amount: B/A/Greg13.A.3(b), Navarrareg8.A.3(b). Select the applicable alternative instead of stacking it. Bizkaia9.17/reg11.4 requires the election in the return and bars changing it after the voluntary filing deadline. Álava105.1(a)/105.2–4 andreg11.4 permit a later change only before a prior administrative request; Gipuzkoa104.1(a)/104.2–3 likewise permits change before such a request. Do not replace those local election windows with a common State deadline or assume that a factual gate failure is cured by an election. Navarra7(n) expressly allows the excess alternative; case-specific late change of that option is not established by this worksheet. B NF13/2013; B DF47/2014; A NF33/2013; A DF40/2014; G NF3/2014; N DFL4/2008.

Residual foreign-tax coordination is territorial. Only the nonexempt salary enters the ordinary local employee calculation and the taxable-foreign-income side of the quota-credit ceiling. Preserve the existing B/A92/G91 and Navarra67 general/savings average-rate method below. Bizkaia's current Instruction15.13.1 expressly compares (a) foreign tax on the full receipts without subtracting tax relating to the9.17-exempt slice, with (b) the local average-rate charge on income left taxable after9.17. Apply the lesser and the actual treaty limits; do not import a proportional foreign-tax reduction into that published Bizkaia method. Fully exempt foreign salary still produces zero ceiling under limb(b), not a refund of foreign tax. B Instruction1/2026 physical169; B NF13/2013 art92.1.

For Álava, own2024 Instruction14.9.1 expressly prorates the foreign tax in the same proportion as the salary remaining nonexempt above60,100; currentart92 retains the lesser-of-tax/territorial-charge test. In a simple single uniform-tax foreign-salary source80,000 with8,000 tax,19,900 remains after exemption and the proportional foreign-tax limb is 8,000 ×19,900/80,000 =1,990. If the independently computed local taxable-income ceiling is4,975, Álava credit is1,990 whereas Bizkaia's published full-foreign-tax limb gives min(8,000,4,975)=4,975. These declared-input controls isolate the actual administrative difference; they do not establish the expense/base ceiling or entitlement for a different source pattern. The Álava instruction is explicitly2024, read with currentart92; no2026 campaign instruction is implied. Gipuzkoa91/Navarra67 require the actual relevant foreign tax and taxable-income ceiling; own implementation for allocating a single foreign-tax amount across exempt and nonexempt wages remains an ordinary question where decisive, and neither the Bizkaia full-tax instruction nor Álava's proportional instruction is automatically theirs. A2024 instruction physical72; A NF33/2013; G NF3/2014; N DFL4/2008.

Bizkaia additionally has its separate art92.2 alternative for permanent foreign employment: more than183days of the tax period abroad performing the relevant contract functions, which must be exclusively foreign, and no9.17 exemption, excess regime or92.1 credit. Its deduction is50% of gross quota attributable to those wages, capped by50% of total general gross quota; exercise the option in the return, with no change after the voluntary deadline. For a case whose sole taxable general income is the qualifying permanent foreign salary and whose established general gross quota is16,000, that alternative is8,000; exactly183days fails its day gate. Attribution of gross quota to such wages in mixed/signed-income cases remains a specific ordinary method boundary, rather than an invented ratio. Do not import this additional Bizkaia option into Álava, Gipuzkoa or Navarra. B NF13/2013 art92.2; B Instruction1/2026 section15.13.2, physical169.

Example 1: the literal Basque day worksheet, single and successive relationships

These are the controls stated under "Foreign-assignment employment: local exemptions", recomputed. An eligible 184-day 2026 relationship with nonspecific salary 18,400, specific foreign-service pay 3,000 and 46 qualifying days: 3,000 + 18,400 × 46/365 = 5,318.90 exempt and 16,081.10 residual gross. The 184-day duration does not replace 365. Successive relationships with nonspecific pay 27,300 / 39 days and 18,400 / 36 days, no specific pay: sum the unrounded components, then round: 4,731.78.

Example 2: foreign-tax credit after the exemption, Álava against Bizkaia

This is the control stated under "Foreign-assignment employment: local exemptions", recomputed. A single uniform-tax foreign salary 80,000 with 8,000 of foreign tax leaves 19,900 nonexempt above the 60,100 exemption. Álava prorates the foreign tax: 8,000 × 19,900 / 80,000 = 1,990. With an independently computed local taxable-income ceiling of 4,975, Álava's credit is 1,990, while Bizkaia's published full-foreign-tax limb gives min(8,000, 4,975) = 4,975. These declared-input controls isolate the administrative difference only.
