Irpf Deductions Asturias in Spain

Calculate Asturias regional credits for ordinary Spanish resident IRPF in 2026, for a taxpayer whose community of residence under LIRPF art. 72 is Asturias. Covers family, care and education; housing, living expenses and sustainability; demographic zones, employment, investment and aid. Each row gives the credit's amount, cap, income gate, sharing rule and article, with incompatibilities and any carry-forward the law allows. Use for deducciones autonómicas Asturias, regional IRPF credits, alquiler, nacimiento, family, housing and gift relief in Asturias. Load es-irpf-deductions first for the residence test, the deduction ledger, the state and regional order of credits, the attributable-tax worksheet, national credits, deadlines and penalties, and es-income-tax for the bases and scales. Split unchanged from es-irpf-deductions on 6 November 2026.

The full skill

Sourced from the law. This revision has not had an independent whole-pack review or accountant sign-off. Calculate regional credits after establishing tax residence and the taxpayer's facts. This Guide holds the Asturias catalogue of es-irpf-deductions, moved here unchanged on 6 November 2026, so that each Guide stays within the size the site can deliver. Specific unresolved interactions are listed in Sources.

Who this applies to

An ordinary IRPF resident whose community of residence for 2026 under LIRPF art. 72 is Asturias. A regional credit reduces regional tax, not the income base. Before applying any row below, use es-irpf-deductions for the residence test, the deduction ledger, the state/regional order of credits, the national credits, deadlines, penalties and the questions to ask, and es-income-tax for the bases, scales and minima. Where a row below refers to "the attributable-tax worksheet under The base", that worksheet is es-irpf-deductions-attributable-tax; national credits, the deduction ledger and any calculation "above" outside this catalogue are in es-irpf-deductions. Basque and Navarre residents use es-foral-income-tax; an IRNR taxpayer or an art. 93 incoming worker does not take these credits.

Rates, bands and thresholds

All amounts are EUR. BI means the specified sum of general and savings taxable income before base reductions (base imponible); BL means base liquidable after the relevant reductions. Use the definition in each row: an income limit based on BI cannot be replaced with gross salary, BL or take-home pay. The table year is 2026 unless a transition is stated.

Asturias: family, care and education

Select the credit using the taxpayer's family, housing and residence facts. The income limits below use general plus savings BI, unless a different test is stated. I/J means individual/joint filing. A 35,000/45,000 limit is not a universal gate for every Asturias credit. The current wording includes Ley 5/2025: its art. 39.1–17 amendments took effect on publication on 31 December 2025, while the electric-vehicle extension in art. 39.21 took effect on 1 January 2026 (Ley 5/2025 art. 39 and final provision 3).

Art. 3 excludes relatives through the third degree and requires neither party to receive regional fostering aid; retain the competent certificate and split equally between entitled cohabiting taxpayers. Adoption credits require cohabitation and the statutory registration/resolution event date; split between entitled individual claimants. Large-family status is determined at accrual, with the competent title and cohabitation; divide between entitled individual filers. Do not apply the assimilated two-child route's income limit automatically to titled large families (arts. 3 and 9–11).

For the single-parent credit, the child must satisfy the article's minority/disability, cohabitation or specialised-institution economic-dependence conditions and non-exempt annual income at most 8,000. Civil-law guardianship/fostering is assimilated. Other cohabitants are excluded except minimum-entitled ascendants; a cohabiting descendant not generating the credit does not disqualify the parent if that descendant's non-exempt income is at most 8,000. Shared custody is excluded. A changed family situation must have existed for at least 183 days. Apply both income tests in the table, rather than ignoring exempt child-maintenance annuities (art. 12).

For nursery relief, require cohabitation and documented eligible costs. Compute the percentage and child cap first, then subtract the Asturias care aid specified in art. 14 bis.5; do not merely subtract aid from the expense base. Split the credit between entitled cohabiting claimants, including where only one meets the income test. In the year the child turns three, prorate by qualifying months, including the birthday month under AEAT's guidance. That guidance expressly applies the higher income limits to both demographic-risk and crisis municipalities despite the shorter wording in art. 14 bis.3. The nursery/care incompatibility is claimant-and-child specific, so it does not prevent different credits for different children (art. 14 bis; AEAT).

The 600 care credit covers descendants generating the art. 58 minimum; it also extends to the period before age 26 where only the age condition prevents that minimum and the remaining art. 58 conditions hold. Do not exclude an older disabled descendant who still generates the minimum merely because of the article's heading. Require cohabitation and equal sharing; prorate by qualifying months in the year of the 26th birthday. For coeliac relief, the defined family comprises the taxpayer, a spouse on a joint return, and minimum-entitled ascendants/descendants. Divide the amount for shared ascendants/descendants equally. The definitive medical report must identify the public-service clinician by CNP/equivalent, or the private-insurer clinician by professional registration number (arts. 14 duodecies and 14 novodecies).

For primary/compulsory-secondary textbooks and school materials, cap actual eligible spending per descendant as follows. The large-family alternative still requires BI at most 26,000 I / 37,000 J. The paying ascendant claims; divide equally where more than one is entitled. Subtract the relevant public grants from the capped deduction per child, rather than applying the percentage to a net expense base (art. 14 ter).

For disability housing, the beneficiary can be the taxpayer or a spouse/ascendant/descendant living with the taxpayer more than 183 days whose annual income including exempt income is at most 35,000. A competent certificate must establish the strict accessibility/sensory-communication need. Include eligible payments and mortgage principal repayments; divide the base cap between claimants for the same ascendant/descendant, with the nearest degree taking priority. Art. 5's former separate relative-housing credit is suppressed (arts. 4–5).

Protected-home relief requires the statutory protected classification. It is limited by actual eligible payments, including qualifying financed repayments. AEAT identifies the acquisition contract/deed year and, for multi-year rehabilitation, the years in which rehabilitation occurs; the 1,000 subsequent-year limit concerns the later qualifying-payment years. Divide the credit cap equally between entitled claimants for the same property. Apply carried amounts after current-year credits, within the three following tax periods and the applicable 1,000 subsequent-year ceiling. Do not refund an unused credit or restart its expiry merely because tax becomes available. A year combining new rehabilitation expenditure and old carried credit requires the interaction confirmation recorded in Sources (art. 6; AEAT).

For rent, divide the statutory cap equally between entitled claimants for the same home; do not duplicate a household cap. For art. 14 decies, include qualifying principal repayments, divide the annual base cap equally where the same property generates more than one claim, and maintain the fiscal address in the qualifying demographic municipality for at least three years. Its large-family route expressly requires the competent title; its single-parent route uses art. 12. Emancipation means leaving the ascendants' home for a new owned/rented habitual home in Asturias; returning to the family home before three years loses that credit (arts. 7, 14 decies and 14 terdecies).

The landlord cap is per taxpayer across properties, not 500 for every lease. Costs must relate to qualifying habitual-home letting, including evidenced preparatory costs. AEAT's guidance uses the state SERPAVI upper reference where no regional reference is established, comparing the monthly rent at 1 January for continuing contracts or at commencement for new contracts. Confirm the reference applicable to the claim year. The guidance gives conflicting instructions for owner charges passed to the tenant, including IBI/community charges; the expressly labelled included-charge worksheet below supplies a bounded administrative route while preserving the contrary exclusion and its exact effect (art. 14 quindecies; AEAT).

Landlord reference gate: included-owner-charge administrative worksheet. Where the claim-year reference is established under the state fallback and the dwelling is within SERPAVI, let R be the documented monthly dwelling rent at the relevant measurement date and C the itemised monthly owner charges contractually passed to the tenant. Use R+C <= U, where U is the applicable verified upper monthly SERPAVI reference. The official completion help10.3.22 expressly includes passed-on owner IBI/community charges, agreeing with the first reference-test paragraph of the practical manual. This selects that published administrative route; it is not a ruling that resolves the same manual's later contrary instruction to exclude charges/tributes contractually borne by the tenant, which names IBI and community charges too. In the crossing band R <= U < R+C, the two instructions give different eligibility outcomes. Preserve both calculations and the source conflict for any challenge or request for clarification; do not represent the selected worksheet as universally settled law.

Use actual charge obligations and the contract's recovery schedule, not every amount received from a tenant. A tenant's own separately contracted electricity or water is not automatically an owner charge passed on. Do not uplift rent by an estimated percentage or divide an annual bill arbitrarily: retain the lease and annexes, owner IBI assessment/community demand, actual agreed instalments and rent/charge receipts. Keep the claim-year reference report with the dwelling's address/cadastral identity, characteristics, upper value and applicable date, plus evidence that the state fallback rather than an applicable regional reference governs. Also retain habitual-home use, capital-income classification, eligible-cost invoices/payments and available regional quota. IBI/community reimbursements used in the reference comparison do not thereby become eligible repair, formalisation, insurance or energy-certificate costs.

Separating fixed full-year example. A sole ordinary landlord has an evidenced continuing habitual-home lease throughout2026, unchanged monthly sums, and a verified applicable upper reference U=700. The rent is R=610; the contract recovers owner IBI in12actual monthly instalments of30 (assessment360) and community charges in12monthly instalments of60 (demand720), so C=90. Tenant-contracted utilities80are separate. The selected comparison is 610+30+60=700, meeting the reference at equality; it is neither610alone nor780including tenant-own utilities. Assume all other conditions pass, this is the claimant's only eligible letting-cost credit, eligible paid repairs400+insurance160+energy certificate80=640, and sufficient regional quota. The credit is min(640,500)=500. The landlord's actual cost ledger, rather than rent or passed-on charges, supplies that credit base.

Change only contractual dwelling rent to620: 620+90=710>700, so this lease fails the selected included-charge gate and no credit is entered under that worksheet. The contrary exclusion instruction would compare620to700and admit the500cost credit on the same remaining facts. That difference is retained as the precise unresolved administrative conflict, not silently converted into a categorical zero legal entitlement. These derived examples assume an actually established reference and constant sums for all occupied months; they do not invent a reference for an uncovered dwelling, alter the existing measurement dates or settle mid-year change/partial-period attribution.

Living-expense categories are housing and associated utilities, education, transport/mobility, technology, sport and culture. Use evidenced actual costs. The statute overlaps age 30 between its final two brackets; AEAT expressly assigns age 30 to the 1,500 bracket and starts the 1,000 bracket at 31. Age is measured when the event giving entitlement to the expense credit occurs; the guidance applies the higher ceiling if the claimant crosses brackets during the year. On a joint return test each qualifying member, rather than imposing one joint-return age cap (art. 14 sexdecies; AEAT).

Forest relief requires an owned forest in Asturias and a competent sustainable-management certificate; claim in the certification year and share equally between entitled individual co-owners. For electric vehicles, retain the sales contract, buyer allocation, qualifying technical category and payment/grant schedule. Art. 14 undecies incorporates the eligible categories in RD 266/2021 annex I, Programme 1; it does not make every MOVES subsidy condition a separate tax-credit condition. The 50,000 base is cumulative for the vehicle, including shared or multi-year purchases. AEAT's 2025 manual predates the statutory extension through 2026; the current statute controls that window (arts. 14 and 14 undecies; AEAT vehicle guidance).

Asturias: demographic zones, employment, investment and aid

Demographic-risk/crisis relief requires the property's or taxpayer's actual qualifying municipality under Decreto 83/2025 and the applicable published updates. Art. 4 distinguishes risk (ISDA 0–8), crisis (8.01–20), unstable (20.01–30) and dynamic (30.01–100); only the first two satisfy the credits above that expressly name them. Annex II supplies the classifications, and final provision 1 requires review/update at least annually. Do not treat the original 2025 town list as a permanent classification for every claim year (Decreto 83/2025 arts. 4–5, annex II and final provision 1).

New self-employment requires activity in Asturias and residence in the qualifying municipality. Exclude collaborating family self-employed persons and partners in capital companies. Claim on initial Social Security/mutuality registration, retain registration at least one year except death, and exclude a restart of the same activity ceased within the previous six months. A joint return can claim 1,000 per eligible person. Transport relief requires named personal public-transport passes; the additional descendant must generate the statutory minimum and study bachillerato, vocational training or university outside the relevant municipality. Apply nearest-degree priority/equal sharing for the descendant; the joint personal-pass ceiling increases by qualifying persons but never exceeds actual costs. Claim in the payment year, regardless of the pass's validity period (arts. 14 quinquies–14 sexies).

Training relief requires entry to qualifying work no later than three years after academic completion, habitual residence maintained in Asturias at least three years, and an employment contract or self-employed registration. The latter registration must continue at least one year, except death. Especially qualified work requires contribution Group 1 and direct/main connection to the statutory activities: basic/applied research, experimental development, advanced innovative software with a favourable regional report, technological innovation/diagnostics, the listed environmental/resource projects, EU-defined innovative companies, justified productive business-promotion projects, or qualifying early-stage/high-growth micro/SME projects. A technical job title alone is insufficient. Claim once in the labour-market-entry year for eligible training costs and do not combine with the work-move credit (art. 14 septies).

The move credit requires no habitual Asturias residence in the preceding four years, residence in the move year and at least three additional years, and an employment contract or self-employed registration. Costs comprise necessary family travel/moving, descendants' Asturias schooling and the habitual-home purchase/rent and connected service/supply contracting costs. The enhanced qualified-work cap uses art. 14 septies.3's definition and is incompatible with that training credit (art. 14 octies).

Investment relief covers SA, SL and cooperatives, including labour companies, with registered/tax offices in Asturias, micro/SME status and genuine economic activity rather than principal asset management. Combined ownership/votes with spouse and relatives through the third degree must never exceed 40% on any day of the year. Formation requires at least one full-time general-regime employee from the first fiscal year. A capital increase must occur within three years of incorporation, increase average employment by at least one full-time equivalent over the prior 12 months during the two following fiscal years, and maintain that increase for another 24 months. Keep the three-year holding and employment schedules separately (art. 14 octodecies).

Do not apply the displayed COVID-aid credit in art. 14 nonies as an operative 2026 credit: the operative ruling in STC 21/2022 declares it unconstitutional and void. The judgment's FJ 4 protection concerns obligations accrued from 31 December 2020 to 9 November 2021, not a new 2026 claim. Art. 8's former rural-land gift credit is suppressed. The ALS route requires a qualifying regional grant included in general BI, but the article does not supply a single flat credit rate; its separate general-rate and liquidable-base calculation is supplied in the attributable-tax worksheet under The base, with the stated signed-income boundary (arts. 8, 14 nonies and 14 quaterdecies).

Worked example

Asturias protected home: carry ceiling and expiry

Hypothetical facts: in 2026 a sole eligible claimant acquires a qualifying protected habitual home and pays 9,000 of eligible acquisition costs. The verified upstream regional calculation leaves 2,000 after all other current credits. Asturias art. 6 generates 5,000: use 2,000, carrying 3,000. Assume no new qualifying expenditure in 2027–2029 and available regional tax after current credits of 700, 2,000 and 2,000 respectively. The subsequent-year ceiling is 1,000, as confirmed by AEAT's protected-home guidance. Use 700, 1,000 and 1,000; 300 expires after the third following period, 2029. It is not refunded or carried into 2030. These tax amounts are hypothetical upstream inputs, not substitute IRPF scales. No co-claimant cap division or new-expenditure/carry interaction arises on these facts.
