Prepare Gibraltar Category 2 certificate applications, annual income classification, capped ABS calculations, part-year minimum-tax working papers and the published IT1C filing/payment workflow. Covers individuals and Rule 11 family elections, previous presence and activity tests, permitted Gibraltar work, property income outside the cap, foreign-income exclusions and elections, certificate continuation and surrender. Uses the current June 2026 Rules and application pack, the 2025-26 return and 2026-27 payment dates. Distinguishes the application fee, certificate advance tax, payments on account and actual bank transfer. Announced wealth-policy implementation, cash allocation and named source conflicts remain explicit; this source-cited draft is not professional attestation.

This is the distinct Category 2 job excluded from the ordinary individual comparison. It addresses certificates under the current Qualifying (Category 2) Individuals Rules 2004, their family elections and the actual IT1C 2026 return for 1 July 2025–30 June 2026, including its separate 2026/27 payment section. Keep immigration, work-permission and treaty-residence evidence separate; this calculation does not establish those outcomes. Legacy Qualifying/HNWI status and HEPSS are different certificate routes; do not select their IT1C certificate boxes merely because they also use that form. Rules 2–3, 5, 11 and 14; IT1C pages 1 and 3.

The temporary rate modifications in rules 3B and 3C concern 2022/23 and 2023/24. Do not carry their higher percentages into 2025/26 or 2026/27. The current ITO FAQ confirms £42,380 maximum and £37,000 minimum, but describes the £118,000 cap as gross assessable income; rule 9(4)(a) actually says taxable income. The computation below follows the operative Rules and records the difference. Category 2 cannot elect GIBS under rule 9(5). Rates Rules 2–3C; Category 2 rule 9; FAQ.
Make a transaction-level schedule showing source/payer, income type, accrual and receipt location, gross amount, applicable Act charge or exemption, supporting document, any election and the destination column below. Section 11 and the applicable Schedule 1 class are the starting point; a bank receipt or certificate label alone does not establish chargeable income. A benefit equivalent to foreign income can constitute Gibraltar receipt under section 11(3). Retain the ordinary individual method for the applicable income/deduction rules, without importing its GIBS election into this job. Act 11 and 25; Rules 9(1)–(2).
The following is a statutory working-paper reading of rules 9–10. For a full-band calculation, calculate the capped tax on the smaller of its supported taxable column and £118,000, then add the rule 10(3)/(4) component at its applicable rate. Record any legally available credit separately. Section 60(6) denies the usual tax credit to a Category 2 individual except for its stated dividends assessable because of rule 10(4); do not automatically copy a company's tax credit into the capped column. Where that exception is proved, apply section 60's gross-up/credit rules with the company's evidence. Apply the relevant rule 9 minimum to the resulting tax payable. The floor is not a deduction, additional income or a second charge added to the computed liability. Shared-deduction allocation and the minimum/credit ordering in mixed uncapped-income or credit cases remain review points; do not finalise those disputed cases from this draft. Rules 9–10; Act 60(1)–(6).
Only the minimum is expressly determined by complete/part certificate months in rule 9(4)(c)–(d). Use actual-year income, not an automatic fraction of £42,380. The printed £3,083.33 gives £36,999.96 for twelve months under those first/cessation-year provisions; do not silently replace that printed multiplication with an invented rounding rule. Part-year ABS band/deduction eligibility, including the Rates rule 2(2) legacy section reference, needs the applicable ordinary method and exact facts before a non-zero part-year calculation is final. The zero-income minimum example below does not depend on resolving that reference. Rule 9(4); Rates rule 2(2).
A written rule 11 election can attribute a spouse/civil partner's or qualifying child's income to the certificate holder. The family member must not be excluded by rule 4. A child is unmarried and meets the stated under-18-at-year-start, full-time-education or articles/indentures limb; do not impose an unstated age limit on the latter limbs. Keep the election, identity/relationship evidence and income schedule. Withdrawal is effective from written notice; the specified commencement of disqualifying activity has its own deemed-withdrawal rule. A family member can instead apply in their own right with the shared-property exclusive-use deeming. Do not claim two separate individual caps/floors for income attributed to one holder. Rule 11.
The certificate is indefinite subject to continuing conditions and the endorsement cycle. Retain evidence of accommodation, permitted activities, financial standing, character and the rule 7 tax-payment conditions as printed. Revocation can run from the Director's identified failure date; a declaration of no chargeability triggers immediate revocation under rule 7(4). Rule 8 advance-tax refunds apply on rejection or relinquishment/surrender, with outstanding tax deducted on surrender. A refundable advance is different from the non-refundable application fee. Rule 14 preserves specified older certificates/legacy elections; do not treat a legacy HNWI certificate as a new Category 2 application or apply its historic 2002–04 two-year transition to a 2026 applicant. Rules 6–8 and 12–14.
Use the June 2026 application and checklist linked by Gibraltar Finance. Complete block capitals: personal/passport/nationality/occupation/address details; family name, birth date, relationship and Rule 11 election column; the accommodation, prior-presence/activity and rule 5 declarations; signature, date and data-consent declaration. Supply the cover letter, passport, CV, character reference, bank letter confirming account-opening date, proof of financial standing and Gibraltar-regulated-intermediary reliance letter. Explain intended Gibraltar business activity for approval. For a family election supply the requested passport, marriage/birth and school-enrolment evidence. These are the authority's published application requirements, not a promise of approval. Application pages 1–3; checklist page 1.
The checklist says submit by email to fcd.category2applications@financecentre.gov.gi; processing awaits the non-refundable fee and all required documents. Keep separate evidence of the £5,000 fee and the rule 8 application advance. Do not send the fee to a guessed tax-payment category or treat either remittance as the certificate itself. Retain the applicable Finance Centre payment instructions and actual receipts. Checklist page 1; rule 8.
Identify the property and obtain approval before entering a purchase/rental agreement. The checklist requires notification and the accommodation form plus rental agreement/deed within two months of application approval; the application declaration uses certificate-approval wording. Record the actual approval letter and both triggers rather than waiting for formal issue where the checklist says issue awaits the deed/contract. The accommodation form asks for estate agent, property address, offer price/rent, proposed buyer/tenant, occupants/relationships, internal/external area, original-plan bedrooms, bathrooms and signed contact details. Future address changes require advance approval under the checklist. Checklist page 2; application page 2; accommodation form.
The checklist also requires the medical-insurance certificate within two months of certificate approval, Gibraltar coverage, at least £100,000 policy value per insured person and the listed inpatient/outpatient, professional fees, diagnostic, therapy, surgical/drug/dressing and European evacuation/repatriation cover. Include elected family members. These are checklist conditions; do not relabel the insurance premium as an automatically deductible expense. Checklist page 2.

Every field above comes from IT1C 2026 pages 1–4. Attach the income classification, elections, deductions/credits, certificate-month/minimum and payment-allocation schedules. The form requires the completed return/documents by email to taxqi@gibraltar.gov.gi, plus photo ID; it expressly says no taxpayer signature is needed. Return and any tax due must be received by 30 November 2026. Keep the exact PDF, attachments, delivery and authority response; sending an incomplete file is not proof of accepted filing. IT1C page 1; Act 28(1) and 39.
Keep separate columns for (a) the rule 8 application/annual maximum-tax advance, (b) statutory payments on account and (c) the return's balance. Rule 8(2) specifies 30 November in the assessment year for its advance. Section 39(2)(b) restricts the statutory payment-on-account basis to its named income classes, whereas IT1C prints a same-as-box-1 estimate. Its two form instalments do not repeal rule 8, prove how an existing advance was credited, or authorise paying the same liability twice. Reconcile the actual tax account by year and payment type before deriving cash still payable; keep the assessment/account allocation and any section 39(5) reduction decision. This cash-allocation interaction is not settled by adding the form's boxes. Rule 8; Act 39(2)–(6); IT1C page 1.
Open the official payment page, follow Income Tax Online Payment Portal to https://tax.egov.gi/, then Fill in a payment form online. The public blank form begins with contact Name, Phone, Email and Next. The published service guide requires the taxpayer's name/TIN where paying for someone else and a plan identifying payment type, period and amount. Prepare separate lines for the correct taxpayer/year/type; check the totals before Finalize and Review. The guide says completion provides a payment confirmation with bank details and an emailed copy. Quote its generated PAYMENT REFERENCE in the actual bank transfer. A payment plan or email confirmation does not itself transfer money. Retain the plan/reference, bank execution evidence and resulting tax-account allocation. The public entry and instructions were read without entering taxpayer data, creating a plan or making a transfer. Payment service guide; official payment route.
The downloads page still links May 2011 qualifying-individual notes. Their December instalment date and old surcharge/penalty structure are historical, not the current timetable. Current section 39 and IT1C 2026 specify January/June instalments. Historical notes; current section 39; current form.
Section 65(2) provides £50 for a section 28 return failure, then further £300 after three months and £500 after six months if it continues. Section 64 adds 10% of unpaid tax immediately after the due date; its further 20% applies to tax and surcharge still unpaid at the statutory 90-day point. IT1C's sentence saying 90 days after “the date of payment” does not replace the Act's due-date/surcharge trigger. Apply actual dates and intervening payments, not an invented flat interest charge. Certificate revocation/payment conditions are a separate rule 7 issue. Act 64–65; IT1C page 1; rule 7.
A certificate and approved home do not determine ordinary residence under every statute, immigration rights, source, foreign tax or treaty entitlement. Retain residence/travel and income-source evidence, and use the Spain residence, UK treaty and foreign-relief jobs where relevant. Do not assume the foreign dividends/pension/office-income exclusion is a foreign-country exemption, or that a voluntary inclusion election creates a foreign tax credit. The rule 11 family election changes this computation's attribution; it does not itself change another country's tax result. Rules 4–5 and 10–11; Act 11.
Assume a full-year continuing certificate, full ABS bands, a documented rule 10(2) election including £150,000 foreign income within that rule, £4,000 of eligible deductions allocated once to that component, and no available credit. The £4,000 is a hypothetical verified deduction total, not a new statutory allowance. Assume Gibraltar rental receipts £12,000 and £2,000 allowable revenue costs, with no further deductions. The capped taxable component is £146,000, limited to £118,000; property profit is £10,000 outside the cap, taxed above the lower-band boundary. Total is £46,280, so the £37,000 floor does not increase it. The maximum £42,380 is therefore not a ceiling on this person's total liability. Without the inclusion election, the foreign-income exclusion must be recorded before recomputing; do not keep the elected amount in the base by habit. Rules 9–10; Act 25; Rates rule 2.

Assume the certificate is first in force 20 March 2027 through 30 June 2027, with no chargeable income after the actual exclusions, no inclusion election, no additional Gibraltar property/activity income and no credit. Four complete/part months give £12,333.32, not four months of the £42,380 maximum. The application requires a separate £5,000 non-refundable fee and the rule 8 maximum-tax advance; their arithmetic sum is £47,380, but that is not the first-year tax liability. The advance's allocation and any later refund require the actual account/certificate events. Rules 8–10; Rates rule 2.
