General reference only. This Guide is general tax/accounting reference material for AI-assisted workflows. It has not been reviewed for any specific person's facts, documents, elections, deadlines, residency, filing status, or local procedures. Do not rely on it to file, pay, amend, or take a tax position without review by a qualified professional in the relevant jurisdiction.
This Guide addresses three specific provisions in Schedule 3 of the Income Tax Act. It is not a catalogue of every Gibraltar incentive. Capital allowances, development aid, property incentives and sector-specific measures need separate work. The claim must match the qualifying expenditure, applicant, approval and period specified by the particular provision. Income Tax Act, Schedule 3, Part IV.

Paragraph 16 permits an employer to claim an additional deduction of 50% of qualifying training costs, alongside the 100% deduction available under paragraph 2(1). The latter requires expenditure wholly and exclusively for producing the business income, subject to its exclusions. Paragraph 16(2) extends the additional 50% deduction to a self-employed individual undertaking qualifying training. Schedule 3, paragraphs 2(1) and 16.
“Qualifying training” means a qualification or training approved by the Commissioner. Course attendance, a provider's marketing description or professional relevance alone does not demonstrate that approval. Obtain evidence that the qualification or training falls within the Commissioner's approval and retain the invoice, cost allocation and business-purpose analysis. The statute does not establish in these paragraphs the complete administrative approval process; that process remains to verify before submitting a claim.
For an eligible £2,000 training cost where the ordinary deduction applies, the additional deduction is £2,000 × 50% = £1,000 and the combined deduction is £3,000. If the £2,000 expense is already included in accounting profit, the additional tax adjustment is £1,000; do not deduct the full £3,000 again. This reduces the income calculation, not the tax bill pound for pound. No tax-rate assumption or refund is built into the example.
Paragraph 16(2A) temporarily increased the additional percentage to 60% for accounting periods or assessment years ending from 1 July 2021 through 30 June 2023. Its test is the period-end date. Do not apply that temporary enhancement to a period ending in 2026 merely because the provision remains printed in the consolidated Act. Schedule 3, paragraph 16(2A).
Paragraph 17 concerns an application under the Town Planning Act that is approved under that Act, for development on or within the applicant's own property, within 24 months of commencing trade. The available credit is up to 100% of architects' fees and fees paid to Government for that application, subject to a £5,000 total cap. It applies against tax liabilities in the first three years of operation, and the portion attributed to an accounting period or assessment year cannot exceed that period's tax payable. Schedule 3, paragraph 17.
The £5,000 ceiling is not £5,000 per year. Nor is the provision a credit for all building costs. Retain ownership evidence, trading commencement, application and approval dates, architects' invoices, Government fee receipts, the qualifying-cost calculation and a schedule of credits already used. Verify a borderline approval or timing case before relying on relief; do not infer eligibility from making an unapproved application.
Example: if eligible costs are £6,200, the statutory total cap limits the potential credit to £5,000. If the tax payable for the period to which £5,000 would be attributed is £3,000, the amount usable in that period cannot exceed £3,000. This example does not establish a refund or automatic carry-forward entitlement for the unused amount. Any allocation to another qualifying period needs to satisfy the first-three-years restriction and the total cap.
Paragraph 17A requires an application by a company, limited partnership or limited liability partnership and satisfaction of the Commissioner. The business must have commenced in Gibraltar on or after 5 July 2016 but before 1 July 2017, be a bona-fide new Gibraltar activity, not a transfer of an existing Gibraltar business or an allocation of its profits, and employ at least five employees in its first year. Schedule 3, paragraph 17A(1).
Where directed by the Commissioner, the credit relates to the first three years of trading, equals the year's tax due up to £50,000 per year, and cannot be carried forward or set off in another year. A business commencing in 2026 fails the stated entry-date condition. The appearance of this historic provision in current legislation does not reopen its window. Do not include £150,000 as a guaranteed new-business benefit. Schedule 3, paragraph 17A(1)–(2).
Prepare a separate working paper for each relief. Record the exact paragraph, eligible person, cost or tax base, relevant dates, approval evidence, amount already reflected in the accounts and adjustment claimed. Reconcile the result to the tax computation and retain it under the tax-records Guide. Use the corporate-tax Guide for the return and payment timetable.
Independent source review and professional attestation remain pending. Current approval procedures, claim forms and the treatment of unusual timing or cost-allocation cases require verification. No claim has been approved by preparing this Guide, and these three provisions do not establish comprehensive incentives coverage.
This Guide does not compute a separate penalty or interest amount for the stated job. Keep the domestic return/payment and dispute requirements in the linked taxpayer Guides separate from the allocation, formation or relief test. The unresolved procedural limits remain listed in Sources. This is a scope boundary, not a finding that no penalty applies.
This job does not by itself determine foreign-country liability or replace a separate residence, treaty, payroll or foreign-tax-relief analysis. Preserve those conclusions separately using the linked country Guides and the facts identified below. No additional foreign exemption or claim method is established here.
This executes the £2,000 current-period training scenario in the method. The approval and ordinary deduction conditions remain necessary; the additional adjustment avoids deducting the accounting expense twice.
