Saint Helena island individual income-tax residence reference checked in 2026. Explains the three alternative statutory residence tests, exact day-count boundaries, employment-contract route, arrival and departure provisions, and the Commissioner’s limited travel discretion. Separates tax residence from immigration and from the source of income. Identifies discrepancies between the published residency leaflet and the official law, including the non-resident employment allowance. Use with documented travel dates, contracts and residence evidence. Does not cover Ascension or Tristan da Cunha, treaty residence, immigration permission, or a complete later-amendment audit. Independent accountant review remains pending.

| Route | Statutory condition |
|---|---|
| Normal abode | Normal place of abode in Saint Helena and presence for more than 90 days in the tax year |
| Physical presence | Presence for periods exceeding 183 days in aggregate in the tax year |
| Employment contract | Presence in the year fulfilling employment exercised in Saint Helena under a contract specified to last not less than 183 days |
These rules concern Saint Helena island. Ascension and Tristan da Cunha have separate laws, as the official legislation introduction explains. The SH jurisdiction code must not be read as extending this Guide to those islands.
The tax year starts on 1 April and runs for twelve months. This Guide addresses the rules checked during 2026, including the tax year 1 April 2026 to 31 March 2027. Income Tax Ordinance, section 2.
Section 2's definition of residence provides three routes for an individual. Meeting one is sufficient, subject to its provisos:
| Route | Statutory condition |
|---|---|
| Normal abode | Normal place of abode in Saint Helena and presence for more than 90 days in the tax year |
| Physical presence | Presence for periods exceeding 183 days in aggregate in the tax year |
| Employment contract | Presence in the year fulfilling employment exercised in Saint Helena under a contract specified to last not less than 183 days |
These boundaries differ. Exactly 90 days does not satisfy the first route; exactly 183 days does not satisfy the second. A contract of exactly 183 days satisfies the duration element of the third route, but the other employment and presence conditions still apply. Do not decide non-residence merely because one test fails. Section 2, definition of resident in St Helena.
Under the same definition, a person resident in the current year but not the preceding year is treated as resident only from their first day present in the current year. A current-year resident who is not resident in the following year is treated as resident only through their last day present in the current year. A final conclusion can therefore depend on an adjacent year's facts.
The Commissioner can disregard a period no greater than one tenth of the relevant day count if satisfied that presence resulted only from infrequent opportunities to travel. This is a statutory discretion, not an automatic traveller adjustment. Keep evidence and any determination with the calculation. Section 2 provisos.
Section 8 charges income earned, accrued or derived in or from Saint Helena, with section 2 providing detailed source inclusions. For example, employment exercised on the island can be within scope even when payment occurs overseas. Certain income from services on vessels is also specifically included. Do not reduce this to a rule that all overseas-paid income is exempt. Sections 2 and 8.
The official residency leaflet describes the normal-abode test as at least 90 days and states that non-residents receive no personal allowance. The statutory text above says more than 90 days. Section 10(3)(b) also expressly provides a monthly allowance entitlement for non-residents receiving Saint Helena employment income. Use the statutory wording, and resolve an individual boundary case before filing. Tax residence does not itself establish immigration status; the leaflet expressly separates the two.
Suggested evidence: travel ledger, accommodation and normal-abode facts, signed employment contract, actual place of work, previous/following-year residence and any Commissioner direction. This is a preparation checklist, not a substitute residence test.
Checked 22 October 2026 against the official Income Tax Ordinance consolidation authoritative at 1 October 2021 and the additional sources linked above. The Gazette index was searched for later income-tax instruments; its Ascension rate orders do not apply to Saint Helena island. A complete audit of later resolutions and instruments and independent accountant review remain outstanding. This is a source-cited draft, not comprehensive coverage of the SH territory code or accountant attestation.
