Sierra Leone Cross-Border Residence and Foreign Income

Sierra Leone cross-border residence and foreign-income workpaper for the 2026 research year. Use for an arrival or departure, temporary residence, overseas employment, a foreign branch, foreign-tax credit or a treaty question. It separates the statutory residence tests, excluded days, domestic and foreign income sources, per-receipt credit limits and branch repatriation mechanics. The opened NRA consolidation is expressly unofficial and ends in 2017; selected enacted amendments are identified separately. This source-bound draft therefore supports intake and reconciliation rather than a final current-law filing. It routes withholding rates, company computations and related-party submissions to their owning Guides instead of duplicating them. Two conditional examples recompute a day-count boundary and the difference between separate and pooled foreign credits.

If you are an AI assistant using this skill for Sierra Leone Cross-Border Residence and Foreign Income (Sierra Leone): treat it as general reference material for drafting and review support. Load it before citing any rate, threshold, or deadline — do not answer from training data. Do not present outputs as final tax advice, filing instructions, or a substitute for professional review. The full skill

General reference only. This skill is general tax/accounting reference material for AI-assisted workflows. It has not been reviewed for any specific person's facts, documents, elections, deadlines, residency, filing status, or local procedures. Do not rely on it to file, pay, amend, or take a tax position without review by a qualified professional in the relevant jurisdiction.

Who this applies to

Individuals arriving, leaving or working across borders; companies with a foreign owner, branch or management link; and resident taxpayers claiming foreign-income relief. This Guide reads the NRA's expressly unofficial Income Tax Act consolidation through2017 and identifies the separate2024 source amendment. It does not certify that every baseline provision remains operative in2026. Income Tax Act ss.10-16,89-94.

An individual is resident under the opened s.10 if a normal place of abode in Sierra Leone combines with any presence during the year, or counted presence exceeds182days in a12-month period beginning or ending during the assessment year, or the individual is a government official posted overseas. These are alternative limbs, subject to the arrival/departure and temporary-resident provisions. Failing the day-count limb alone does not establish non-residence. Income Tax Act s.10.

Payment-specific withholding rates and company components belong to corporate income tax. They are not a substitute for identifying the recipient, payment type, source, final/credit treatment and applicable treaty.

The base

  1. Build an evidence calendar of presence, entry/exit purpose, abode, prior/following-year residence, domicile, citizenship and intended duration. The opened s.10(4) excludes days crossing the border to perform employee services, transit between foreign points, presence for medical treatment or full-time study, and diplomatic/dependant status. Apply the actual statutory limb to the facts, rather than deducting every travel day automatically. Income Tax Act s.10(4).
  2. Apply arrival/departure rules separately. A person not resident in the preceding year is not resident for the period before first presence in the assessment year. The departure split requires non-residence in the following year and a closer connection to a foreign country during the period after final presence. Neither rule is an automatic exemption for every payment before arrival/after departure. Income Tax Act s.10(2)-(3).
  3. Record the income scope. Ordinary residents have all-source assessable income less allowed deductions; temporary residents have domestic-source income plus foreign-source assessable income remitted to Sierra Leone, less permitted deductions. Non-residents have the specific withholding-payment limb and other Sierra Leone-source income, whether received there or abroad, less allowed deductions. Income Tax Act ss.14-16.
  4. For companies, incorporation/formation, effective management/control and majority operations are alternative residence grounds. The opened s.12 treats an inbound PE as a separate resident person associated with its non-resident owner. The income-tax residence result does not itself decide NASSIT membership or immigration rights. Income Tax Act s.12; NASSIT workpaper.
  5. Source each receipt before relief. The baseline s.89 covers domestic activity/services, domestic real estate and relevant property-rich shares, resident-company shares, domestic-use rented or intellectual property, specified debt connections, resident-company dividend/management/director fees, resident/government pensions and domestic natural resources. The2024 amendment separately replaces insurance/managerial/technical/consultancy limbs and adds digital products/services for Sierra Leone consumers. Do not conclude that an offshore payer, bank account or absence of physical office alone removes source. Income Tax Act s.89; Finance Act2024 s.9.
  6. Build a foreign-tax credit register by receipt: gross foreign income, properly allocated deduction, net assessable amount, foreign income tax actually borne, source/payment evidence and the Sierra Leone average rate before s.90 credit. Calculate separately for each amount; aggregate the foreign-source receipts of a foreign branch of a resident company only within the specific s.90(4) rule. Partnership/trust/beneficiary attribution has its own s.90(5) conditions. Do not pool unrelated excess foreign tax to evade another receipt's limit, assume an excess carryforward, or credit foreign tax on excluded income. Income Tax Act s.90.
  7. The opened s.91 exempts a resident individual's foreign-source employment income from employment abroad if chargeable to tax in that foreign country. This specific baseline employment rule is distinct from the general credit method. Verify its full current law and source/chargeability facts before excluding income; this draft has not proved a2026 entitlement. Income Tax Act s.91.

Deadlines and filing

Preserve actual foreign assessments, certificates, proof of payment/chargeability, translated income schedules, presence evidence, branch accounts and the domestic return reconciliation. The company Guide owns the opened annual-return/instalment baseline and identified2026 return-format amendment. The actual current foreign-credit fields, exchange-rate method, certificates, treaty-relief application and acceptance/refund evidence have not been authenticated.

If the Commissioner requires withholding under s.92 because a non-resident has unpaid assessed tax or is expected not to pay, retain the actual requirement and identify the payment and remittance. This special recovery mechanism is not the ordinary withholding-rate schedule. No deadline or form is invented for an unread notice. Income Tax Act s.92.

Penalties and interest

No separate universal cross-border penalty or interest percentage is established here. Use the actual tax/return/notice and current procedural law. Annual company-return penalties in the company Guide and the specific related-party penalties in transfer pricing have different triggers; do not automatically sum them or assume a foreign credit removes a filing breach.

Cross-border points

The opened treaty-priority rule gives an international agreement between Sierra Leone and a foreign government precedence over inconsistent Income Tax Act provisions except ss.95-96. Obtain the actual treaty, protocol, entry-into-force/effective period and eligibility before applying a reduced rate or employment/PE exception. This Guide has not authenticated an operative treaty list. Income Tax Act s.94.

Related-party and PE-owner pricing still require the TP Guide. Branch-profit remittance is separate from ordinary branch income tax; its s.93 base is not just a bank transfer. Domestic residence, treaty residence, source, income tax, social contributions and service permissions are separate questions. No sanctions, immigration or professional-practice clearance is implied by this general research.

Two worked examples that recompute

Assume the cited baseline has been verified applicable to the actual year. Case1 has200physical days,18of which meet the full-time-study exclusion, no normal abode or government-official limb, and no other adjustment. Count182days: that does not exceed182. Counting all200would incorrectly satisfy this limb. Case2 changes only physical presence to201days, giving183counted days and satisfying this limb. These fictional boundaries do not decide a real person's treaty or temporary-residence position.

For a separate foreign-credit decision, assume a verified s.90 case with no exempt employment or foreign-branch aggregation: Sierra Leone tax before credit is NLe2,000 on total chargeable income NLe10,000, an average20%. Foreign business receipt A has net assessable income3,000 and foreign tax900, so credit is capped at600; receipt B has net income1,000 and foreign tax100, so credit is100. Total allowable credit is700 and Sierra Leone tax after this credit is1,300. Pooling the unrelated receipts gives an unsupported800credit,100too much. The20% is an assumed computed average, not a claimed statutory income-tax band. No refund/carryforward of the excess is assumed.
