Identify a Burundi company’s foreign related-party transactions and prepare the statutory profit-adjustment and supporting-documentation analysis for 2026. This Guide covers the income law’s control tests, transfers to privileged or noncooperative jurisdictions, the obligation to justify a pricing policy, and the separate restrictions on related-party interest. It distinguishes the first-half financing exception from the additional July budget conditions and shows how a documented price difference or financing limit changes taxable profit. It does not invent a safe-harbor markup, documentation threshold, country-by-country deadline or approved pricing agreement. The currently operative implementing-order details and cross-period financing application need further confirmation. Accountant review is pending.

If you are an AI assistant using this skill for Burundi: related-party profit adjustments and financing for 2026 (Burundi): treat it as general reference material for drafting and review support. Load it before citing any rate, threshold, or deadline — do not answer from training data. Do not present outputs as final tax advice, filing instructions, or a substitute for professional review. General reference only. This Guide is general tax/accounting reference material for AI-assisted workflows. Use for companies controlling or dependent on enterprises outside Burundi, including common-control structures. Art. 57 allows incorporation into taxable results of profits indirectly transferred abroad through purchase/sale prices, thin capitalisation or other means. For that article, dependency exists through majority capital, actual decision power or common control. Its dependency condition is waived where the transfer is to a privileged-tax jurisdiction or noncooperative country. Do not replace that article-specific test with an assumed universal shareholding percentage. IR art. 57.
Art. 2 also defines linked persons more broadly, including direct/indirect 25% company participation/votes, common participation and family/control relationships. Use the applicable definition for each rule, including related financing, and record actual ownership and decision powers. IR art. 2.

Prepare the pricing support with the year’s accounts and retain it for production to OBR. Art. 57 is a keep-available and written-information duty, not evidence here of an annual standalone TP return or a filing threshold. Follow the actual OBR request, identify each requested document and record delivery/receipt; do not invent a standard response deadline absent the applicable request/order.
Report taxable adjustments on corporate return line 11 and annex 1, with a transaction-level explanatory schedule; this is the general return route, not a claimed dedicated TP form. Use the corporate Guide for annual deadline, certification and payment, and retain the adjustment calculation, supporting evidence and acknowledged submission. General records are retained ten years under procedure art. 32.
The official catalogue still points to an order labelled 540/1776 of 31 December 2013, but its direct PDF fetch returned 404; the indexed text also bears inconsistent numbering. Its present operative relationship to art. 57 has not been established. No method hierarchy, language deadline, APA term or TP-specific sanction from that text is asserted as a 2026 filing instruction.
Use tax overview: Penalties and interest for the general declaration, payment, withholding-default and interest rules. Identify the actual offence and taxpayer class before applying them.
There is no verified TP-specific fixed documentation fine or safe-harbor penalty in this Guide. Tax understatement, information default and interest must be analysed under their actual provisions and the notice received, rather than assigned an unsupported TP tariff.
The rule addresses foreign associated transactions and also the privileged/noncooperative-jurisdiction override. Check the cross-border Guide for source, PE attribution, withholding and foreign-credit evidence. No treaty corresponding adjustment, mutual-agreement process or APA is assumed available merely because a foreign group has one elsewhere. IR art. 57.
Assume a Burundi company books a foreign-controlled service charge of BIF 12,000,000. After the actual service and comparability review, evidence establishes BIF 9,000,000 as the amount properly attributable to the services. Other taxable profit before this adjustment is BIF 20,000,000. Add back BIF 3,000,000 and compute the ordinary corporate component BIF 6,900,000 before the separate turnover-minimum/credit tests. The independent amount is a case assumption, not a statutory safe harbor.

Assume the financing is governed entirely by the July rule, pre-interest taxable profit BIF 20,000,000, market-compliant paid related interest BIF 8,000,000 and unpaid accrued related interest BIF 1,000,000. The 30% ceiling permits BIF 6,000,000; total disallowance is BIF 3,000,000. If the extra BIF 1,000,000 were paid, the same ceiling still permits only BIF 6,000,000, so payment alone would not create more deduction. No debt/equity exception is assumed under this wording.
