Classify cross-border income under Burundi’s domestic rules before calculating tax or applying an asserted treaty benefit. This Guide covers ordinary residence tests, domestic income source, fixed-place and service or construction permanent establishments, the source-withholding categories and capped foreign-tax credit with documentary requirements. It gives the published monthly withholding fields and separates withholding from the recipient’s ultimate business or capital-gain liability. The Morocco ratification and treaty commencement wording are read without assuming an exchange of instruments or a 2026 reduced rate. Complete treaty-by-treaty effectiveness, diplomatic residence details, exchange controls and authenticated filing screens remain unresolved. Accountant review is pending.

Use for a Burundi payer, a resident with foreign income or a nonresident with Burundi activity. An individual is resident if there is a permanent residence in Burundi or presence exceeds 183 days in a twelve-month period ending in the fiscal year; diplomatic/public-service residence cases require the remaining art. 3 condition, which is not fully legible in the captured scan and is excluded here. An entity is resident if constituted under Burundi law or effectively managed here at any time in the fiscal year. Residents include foreign-source income; nonresidents include Burundi-source income. IR arts. 3–7, 20 and 100–102.
Source includes employment/activity here, services physically or electronically supplied to a Burundi resident or Burundi PE, local immovables and specified investment/disposal income. Do not infer a foreign source from foreign invoicing or payment alone. IR arts. 6–7.

Apply the PE analysis before using final nonresident service withholding. A fixed business installation with permanence can be a PE; construction and service periods above are additional tests. Check the narrowly specified storage/display and preparatory/auxiliary exclusions, habitual contracting or stock-delivery dependent agents, independent agents acting in their ordinary business and the special insurance rule. Ownership/control alone does not create a PE. A PE requires separate books and profit attribution; the corporate Guide owns that computation. IR arts. 8–13 and 108–109.
For withholding, identify payer, recipient, payment category, gross payment and PE attribution. Both 2026 budgets replace art. 122 with the categories above; their identical core rates do not authorise withholding on every foreign payment. PE payers also apply the withholding rules. Keep a category schedule and certificates. A buyer's nonresident-asset withholding is not a substitute for the seller's gain-base computation. Art. 148; Art. 156; IR arts. 123–129.
For foreign credit, prove country/tax-authority address, income-tax amount, reason, year and date/mode of payment using an assessment, withholding certificate or similar acceptable evidence, certified by the issuing foreign tax authority. Attach it to the return, or supply the proof within six months after Burundi tax becomes due; otherwise the deducted credit must be repaid with applicable interest/penalties. If not in Kirundi, English or French, provide a certified translation into one of those languages. This is a credit ceiling, not a guaranteed refund of all foreign tax. IR arts. 14–15.
Keep VAT on imported services separate from income withholding; use VAT even if the recipient is not VAT-registered. Use transfer pricing for group charges and financing, rather than treating withholding payment as proof of expense deductibility.
Use tax overview: Penalties and interest for the general declaration, payment, withholding-default and interest rules. Identify the actual offence and taxpayer class before applying them.
Treaty relief needs an applicable treaty, its actual entry into force and effective tax period, residence/beneficial-entitlement evidence and anti-abuse conditions. The OBR treaty catalogue is a locator, not proof every listed agreement governs a 2026 payment.
Burundi's Law 1/01 of 17 February 2026 ratifies the Morocco convention signed in 2025. The actual convention's art. 30, PDF p. 21 requires exchange of instruments and then applies withholding provisions to amounts paid/credited from 1 January of the following calendar year; other taxes also use following-year periods. The domestic ratification alone does not establish a 2026 reduced withholding rate. No date of exchange or treaty rate is asserted by this Guide. Treaty rates, residence tie-breakers, dependent-services exemptions and treaty-specific PE changes need their own completed check.
Assume a resident Burundi company pays BIF 10,000,000 gross for taxable nonresident services not attributable to a Burundi PE, with no established treaty relief and no contractual gross-up. Income withholding is BIF 1,500,000 and cash paid to the supplier BIF 8,500,000. Imported-services VAT is a separate calculation, not subtracted here.

Assume properly evidenced foreign income tax of BIF 4,000,000 versus BIF 7,000,000 in two otherwise identical cases, with BIF 20,000,000 foreign taxable business profit, 30% applicable Burundi tax and no other limitation or minimum-tax interaction. Burundi tax before credit is BIF 6,000,000. The lower foreign tax leaves BIF 2,000,000 Burundi tax; the higher case gives only BIF 6,000,000 credit, leaving BIF 1,000,000 foreign tax outside the credit. The larger foreign payment does not produce a Burundi refund.
