Burundi: property transactions and electronic-title charges for 2026

Prepare a Burundi property acquisition, mortgage-registration or electronic-title workpaper for calendar 2026. This Guide separates the January and July budget periods, identifies the purchaser’s property wealth tax, calculates the statutory mortgage charge and electronic-title fee, and keeps urban building-permit tax separate from transfer costs. It also identifies the principal land-registration valuation, notarial, notification and security-document rules. Rental income and the seller’s income-tax gain belong to their existing Guides. The current transfer-tariff order, geographic title-category assignment, actual title application form, complete conveyancing invoice and annual land-tax computation remain unresolved. This partial draft passed independent AI source review within its stated scope, with no accountant attestation.

The full skill

General reference only. This Guide is general tax/accounting reference material for AI-assisted workflows. It has not been reviewed for any specific person's facts, documents, elections, deadlines, residency, filing status, or local procedures. Do not rely on it to file, pay, amend, or take a tax position without review by a qualified professional in Burundi.

Who this applies to

Use for a purchaser, owner, secured creditor or urban house builder preparing the specified property charges and registration workpaper, not an all-in conveyancing quotation. An immovable includes a building or fraction and built or unbuilt property for the wealth-tax clauses. Classify the transaction, acquisition sequence, title/certificate and date first. The modified budget commences 1 January 2026; the next budget commences 1 July 2026. The two periods are not interchangeable. January budget art. 252; July budget art. 277.

The principal registration law distinguishes fixed, proportional and progressive duties and a mutation of private ownership, including acquisition between living persons, on death or by an enforceable judgment. This Guide uses its actual procedural clauses with the budget overlays below; it does not treat the unreconciled 2020 transfer tariff as proof of the final 2026 bill. Registration law arts. 2–3.

Annual landlord income belongs to individual income tax, with company computation routed through corporate income tax. Seller gains and their relief/registration-duty credit belong to the income-tax owner Guide; this Guide does not repeat their rates. Annual land ownership tax is a separate unresolved job. Income-tax Guide: The base.

The property wealth tax is an acquisition charge under the quoted clauses. It is not an annual percentage on aggregate net wealth. Vehicle wealth-tax rules in the same article are outside this job. For a first or second acquisition below the property threshold, these property clauses do not themselves impose that wealth tax; that does not remove transfer duty, title fees, VAT or the seller’s income tax. Confirm the statutory acquisition count rather than assuming each fraction or joint purchase has a resolved counting treatment. January art. 138; July art. 146.

The base

  1. Separate charges. Keep a distinct line for the purchaser’s wealth tax, mortgage charge, electronic-title charge, construction tax and unresolved transfer duty/other fees. The mortgage base is the total debt/credit, not only the amount entered as security or the property sale price. A secured-title fee cap does not cap another tax. January arts. 138–142; July arts. 146–150.
  2. Registration valuation. Under the principal law, transfer duty is computed on the price or value determined under art. 5. An exchange uses the agreed value of the side that would give the higher duty if priced in money. A missing, insufficiently determined or below-market price requires a certified, signed value declaration at the foot of the deed; if a party cannot write, the registrar records it before two signing witnesses. The base cannot be less than market value, and contract prices are stated in BIF. The registrar can substitute an assessment or expertise; the competent local court can order expertise at the parties’ request. Registration arts. 4–7, 19–20.
  3. Split rights are not a full-ownership shortcut. For creation/transfer of usufruct, including a limited term, the price base cannot fall below 75% of full-ownership market value; without a determined price use full-ownership market value. For bare ownership with usufruct retained by the transferor, the floor is full-ownership market value; otherwise the law deducts the usufruct value estimated under art. 6. A later transfer of usufruct to the bare owner is exempt from proportional duty and subject to fixed duties only where proportional duty was already paid on full value by that bare owner or a predecessor from whom the right derives. Registration arts. 8–10.
  4. Emphyteusis. Creation uses the cumulative dues over the right’s duration; transfer uses dues for the remaining duration. Transfer of the underlying property, wholly or partly subject to emphyteusis, uses full-ownership market value. Registration arts. 11–13.
  5. Exemptions require the right party and tax. State and administrative public establishments are exempt from fixed, proportional and progressive registration duties only for transfers in their favour. Communes have the stated exemption from proportional duties only for transfers in their favour. Art. 15 exempts proportional duty for the specified gratuitous transfers to a religious denomination or scientific/philanthropic association with legal personality, or from such a body to another institution/association of the same nature. These principal registration exemptions do not by themselves exempt every property tax. A separate 2026 budget overlay exempts gifts granted to the State and its administrative subdivisions from all taxes, duties and charges: January art. 207 applies in the first period and July art. 226 in the second. Confirm both the gift and qualifying beneficiary; this does not make an ordinary purchase exempt from all taxes or extend that gift rule to every religious/scientific/philanthropic body. Do not equate an administrative public establishment with an administrative subdivision without confirming its legal status. Registration arts. 14–15; January art. 207; July art. 226.
  6. No invented transfer tariff. Both budgets require the finance, justice and infrastructure ministers to update property-transfer rates by order. The actual 2020 annex was read, but the operative updated tariff/order has not been reconciled. Do not turn its historic sale, gift, succession or restructuring rows into a final 2026 conveyancing quote. State pre-emption is available where the sale price of built or unbuilt property is understated. January arts. 103–104; July arts. 108–109.

Property VAT remains a separate classification gate. July budget arts. 95, 246 and 247 address undefined building use, specified gifts and mixed-use buildings; January arts. 94, 226 and 227 must be checked for a first-half event. Route the actual supply and deduction computation to VAT, and obtain the property-specific implementing text before computing an unresolved mixed-use allocation. A gift is not exempt from all taxes merely because it is between relatives. January arts. 94, 226–227; July arts. 95, 246–247.

Deadlines and filing

  1. Before signing: obtain identity/NIF, transaction type/date, property identification, title or communal certificate, title extract, area/category evidence, price/valuations, acquisition sequence and finance documents. The principal law requires anyone asked to sign a transaction/deed concerning titled property, including a notary/public officer, to obtain a land-register extract beforehand; its validity is 60 calendar days. If the property’s physical substance has changed, update the sketch, survey/boundary record and title before transfer, mortgage or other real-right constitution. Registration arts. 23, 25.

  2. Authentic deed and tax schedule: the budget requires authentic notarial form and deposit among the notary’s minutes for the described real-right transactions and urban property leases. For urban transactions within this wording, do not treat an informal signed contract as sufficient. A constitutive/transfer deed of real property rights lists all applicable fees/taxes, payable no later than 30 days after signature of the authentic deed. Keep this payment clock separate from the registration-notification clock. The prescribed contract format/mandatory-mentions order remains unresolved. January art. 141; July art. 149. Separate weekly notary/public-officer reporting: at the end of each week, without undue delay, the notary or public officer who authenticated or signed a transfer, mortgage-constitution or other real-property-right act sends the territorially competent registrar the list of those acts. Include the parties’ names and given names or business names; act number and object; total transaction price stipulated in the deed; parcel location; cadastral or parcel number; and title number if any. This is separate from the parties’ transfer-notification deadline below. Registration art. 23, continuation.

  3. Transfer notification: communicate a mutation of titled immovable property or another real right over it to the territorially competent registrar within 60 days following signature. For a sale under communal land certification, the buyer must convert the certificate to a title within 60 working days from signature, a different unit of time. A built-property transfer application also needs an insurance certificate covering fire. Registration arts. 24, 32; January art. 217; July art. 237.

  4. Mortgage dossier: request inscription within eight days following signature of its constitutive deed, with an updated expertise report valuing the property on that date under banking law. The report is entered in the mortgage register and signed/sealed by the registrar. An annotation of a mandate to mortgage or a partial mortgage inscription is prohibited. In communes with land services, the guarantee constitution/inscription on certificates or titles requires a non-liability certificate in the names of debtor, grantor and any surety, issued by the commune administrator or competent registrar, as appropriate. After inscription, obtain the certificate for creditor and debtor recording title references, general/special act number, date, secured debt, duration and any renewal date. Registration arts. 26, 30, 33.

  5. Electronic-title conversion: every landowner must obtain the secured electronic title. The January text gives holders five months counted from 1 January 2026 to apply; this Guide does not invent a procedural last-day convention. The July text requires application before 31 March 2027, using the form established by the land-title/national-cadastre directorate and posted on the justice ministry site. Read the actual form and category/location order before completing the file; neither has been recovered for operational use here. Do not treat the later deadline as an express waiver of an earlier failure. January arts. 142–143; July arts. 150–151.

  6. Payment and completion: principal-law registration entries that attract duties occur only after payment. Contesting the amount does not postpone payment under that clause, without prejudice to restitution. Keep the authority’s assessed breakdown, payment receipt, lodged-deed acknowledgment and updated title/registration certificate. This research has not verified the current payment account/reference, electronic-title form fields, appointment/submission channel, acknowledgment format or actual service turnaround. Do not mark a submission complete from these statutory steps alone. Registration art. 18.

  7. If building an urban house: obtain the prior building authorisation and approved estimate, pay the building tax, then display the authorisation reference and proof of tax payment on the site. The separate permit-insurance clauses make grant of the building permit conditional on an insurance certificate covering damage to the works and decennial and biennial liability when the value of the work to be built is estimated at BIF 100,000,000. The exact legislative condition is « lorsque la valeur de l’ouvrage à construire est estimée à cent millions »; it does not say “at least”. Do not invent a >= threshold or conclude that other estimates are exempt. Its broader application, current required insurance evidence and permit implementation remain held. This is distinct from the fire-insurance certificate for a built-property title transfer. Read the applicable implementing order before an actual permit request. January arts. 139, 215; July arts. 147, 235.

Penalties and interest

  • Refusal or delay in transmitting the separate weekly notary/public-officer list attracts BIF 50,000 per untransmitted act plus 1% of duties due per week late. Apply this art. 23 sanction to that reporting duty, separately from the parties’ art. 24 transfer-notification charge. Registration art. 23, continuation.
  • For the principal-law transfer notification after its 60-day clock, art. 24 imposes 1% of duties due per week late on the parties; it states an increase to 5% where delay is attributable to the transferor, without prejudice to buyer damages. Check attribution, clock and the actual charge; do not calculate a generic daily interest rate. A mortgage inscription beyond its eight-day clock attracts 1% of duties due per month late, borne by the creditor. Registration arts. 24, 26.
  • A requested valuation shortfall reaching one fifth of market value attracts a fine equal to the evaded duties, without prejudice to other fiscal sanctions. For a transfer/inscription based on an alienation contract, art. 17 makes transferor and purchaser jointly and indivisibly liable for that fine. Concealing total mortgage debt or requesting partial inscription likewise attracts an evaded-proportional-duty fine; the provision also catches a notary/public officer/agent who contributes to concealing the debt or transaction price. Registration arts. 16–17, 27.
  • The July electronic-title clause imposes a fine of 50% of the secured-title amount on a titleholder missing its application deadline. It is linked to the before 31 March 2027 obligation; do not apply it to an ordinary timely 2026 application or retrospectively label it the January clause’s penalty. July art. 151.
  • Failure to display an urban building-authorisation reference costs BIF 500,000, without prejudice to tax due. Starting without authorisation attracts BIF 1,000,000, in addition to one per thousand of an estimate prepared by an authorised expert at the taxpayer’s expense. The text does not make these alternative offences a single automatically cumulative fine. January art. 139; July art. 147.
  • The principal registration law gives a two-year period from registration for recovery of evaded duties/fine, and a two-year restitution period from when that action arises. Keep these specialised clauses distinct from the general tax-audit periods; unresolved interaction with a particular later procedure or fraud rule needs referral. Registration art. 21. General tax-default rules are in tax overview.

Cross-border points

The cited property wealth-tax clauses identify the acquirer and property conditions, without a residence-based concession in those clauses. Do not infer a foreign purchaser’s exemption, ownership permission or treaty reduction. Residence, domestic source withholding and treaty-effectiveness evidence belong to cross-border tax; the seller’s individual gain belongs to income tax. Foreign-ownership eligibility, exchange-control transfer steps, nonresident conveyancing representation and treaty relief on this property transaction remain unresolved. January art. 138; July art. 146.

Two worked examples that recompute

1. Electronic-title fee with an evidenced category and area. An owner has an authority-confirmed category C parcel of 61 ares. The raw fee is 61 × BIF 50,000 = BIF 3,050,000, capped at BIF 3,000,000. This calculation does not assign category C from the address and is not the complete conveyancing bill. If the holder later misses the July clause’s application deadline, its specified 50% fine would be BIF 1,500,000; no fine arises merely from this timely 2026 calculation. July arts. 150–151.

expected:
  uncapped_fee: 3050000
  title_fee: 3000000
  fine_if_deadline_missed: 1500000

2. Acquisition sequence and the inclusive wealth-tax threshold. Assume the higher market/counter-expertise value, excluding VAT, is also the established taxable value. A second acquisition at BIF 499,000,000 does not reach the quoted threshold. At exactly BIF 500,000,000, the second acquisition produces BIF 25,000,000 of property wealth tax. If the same BIF 500,000,000 property is the confirmed third acquisition, the specified third-property rate gives BIF 50,000,000, a BIF 25,000,000 difference. This is classification, not an election to hide a prior acquisition. Later-acquisition and joint-fraction counting questions are held. Other taxes remain separate. January art. 138(b)–(c); July art. 146(b)–(c).

3. The mortgage-period decision changes the cap. For the same BIF 12,000,000,000 total credit, 0.5% is BIF 60,000,000. A transaction governed by January art. 140 has a BIF 50,000,000 capped fee. A transaction governed by July art. 148 has BIF 60,000,000 under that replacement text, which omits the cap. Do not choose the earlier cap for an August deed. A cross-period deed/renewal needs its actual chargeable-event determination before deciding which text governs. January art. 140; July art. 148.

4. Permitted urban construction versus starting without permission. With an authorised-services-validated estimate of BIF 80,000,000, the building tax is BIF 80,000. For a separate case of work started without permission, assume the authorised expert’s estimate is also BIF 80,000,000. The specified tax plus unauthorised-start fine is BIF 1,080,000, before the separate cost of the expert or any other properly identified obligation. The display offence is not automatically added. Not yet confirmed: operative updated property-transfer tariff and complete invoice; electronic-title category/location order and actual form/fields, payment reference/channel and final acknowledgment; counting of joint interests, fractions and later acquisitions under the wealth-tax clauses; mixed-period chargeable events and January deadline computation/interaction; property-specific VAT allocation/order; annual land-tax base, rates, exemptions and current communal-law chain; nonresident ownership/representation/exchange controls; construction implementing order and permit forms, including broader interpretation of the exact BIF 100,000,000 permit-insurance condition and current required insurance evidence; interaction of specialised registration limitations with later procedure/fraud provisions. An indexed 2025 electronic-title order returned 404 directly and in the ordinary browser; no dated archive text was recovered. The communal-law file on a government commune’s 2026 upload path is actually the 2016 law, so its rates are not promoted to 2026. Independent AI source review and focused repair closure passed within this Guide's stated scope; all seven pack tax domains remain partial, with no accountant attestation or authenticated filing.
